Certainty Of Arrest And Crime Rates For Major Felonies: Research Note, William C. Bailey

A recent investigation by Tittle and Rowe (1974) examining the deterrent effect of the certainty of arrest on felony rates in Florida is briefly summarized and critiqued. Examination shows their analysis to suffer from serious theoretical and methodological limitations. To extend their investigation and thus better understand the deterrent effect of arrest we examine the relationship between arrest rates and offense rates for cities and counties of Florida for seven major felonies. Analysis lends general support to the deterrence argument, but shows that the effect of arrest is not uniform for each offense, with different levels of arrest (certainty of …

Multiple Rainbows From Single Drops Of Water And Other Liquids, Jearl D. Walker

The scattering of light by spherical drops and the theory of rainbows are reviewed in detail to predict the angular positions of rainbows from single drops. The angular positions of the first 13 rainbows of water, observed from a drop suspended in a student spectrometer, were compared to these theoretical positions. Since the rainbows were dependent on the refractive index, the positions shifted with drops of other fluids having other refractive indices. Light corn syrup yielded 11 rainbows, including the 17th-order one. The light emerging from the drops was white except for the multicolors of the rainbows and the faint …

Crime, Punishment And Personality: Examination Of Deterrence Question, William C. Bailey, Ruth P. Lott

While the presumed deterrent effect of punishment provides the cornerstone of the criminal justice system, it would be a mistake to assume that deterrence is well established in both theory and research. Recognizing the limitations of deterrence investigations, this study examines the relationship between a person's perceptions of punishment and their actual criminal involvement. Most deterrence investigations have focused primarily upon homicide and the death penalty. Although these investigations suggest that the threat of sanctions may have an important deterrent effect, careful examination shows them to suffer from serious theoretical and methodological limitations. Federal Courts, Injunctions, Declaratory Judgments, And State Law: The Supreme Court Has Finally Fashioned A Workable Abstention Doctrine, Clair E. Dickinson

Cleveland State Law Review

The American judicial system is founded on several policies which act as guideposts for the courts. Among these is the policy that states should be as free from federal control as possible. At the opposite end of the spectrum is the view that federal courts have a duty to protect individuals from violations of their constitutional rights. These policies meet, and seemingly clash, when a plaintiff enters a federal court either to request a declaratory judgment that a state statute is unconstitutional or to seek an injunction against the enforcement of the statute. On October 1, 1976, Amended House Bill 531 became effective as sections 2307.31 and 2307.32 of the Ohio Revised Code. As stated in the preamble, the purpose of the Act is to provide for the contribution among two or more persons jointly or severally liable in tort. Like all new legislation, it is bound to have a certain amount of "teething problems" in its initial use. This Article will discuss some of the anticipated problems, and propose suggested means for resolving them.
