Psychosocial Analysis Of An Ethnography At The Cuyahoga County Public Defenders Office, Ernest M. Oleksy Dec 2018

Psychosocial Analysis Of An Ethnography At The Cuyahoga County Public Defenders Office, Ernest M. Oleksy

The Downtown Review

Too often, social science majors become jaded with their field of study due to a misperception of the nature of many potential jobs which they are qualified for. Such discord is prevalent amongst undergraduates who strive for work in the criminal justice system. Hollywood misrepresentations become the archetypes of the aforementioned field, leaving out the necessity and ubiquity of accompanying desk work. Still other social science majors struggle to identify theoretical interpretations in praxis.

Multiple Regression Models To Analyze Length Of Hospitalization Due To Nosocomial Infections In U.S. Hospitals, Ernest M. Oleksy

The Downtown Review

Nosocomial diseases are a serious concern and detriment to hospitals’ abilities to provide appropriate patient care. Bearing this in mind, an effort must be made to determine whether infection surveillance and control programs have reduced the rates of nosocomial infection at U.S. hospitals. The data that were studied were obtained as part of the Study on the Efficacy of Nosocomial Infection Control (SENIC) and used to develop a model of what variables most contribute to a patient’s length of stay at the Cleveland Clinic (Quade et al, 1980).

Grit & Ghetto: American Pop Music From The '90s To The '00s, Ernest M. Oleksy Dec 2018

Grit & Ghetto: American Pop Music From The '90s To The '00s, Ernest M. Oleksy

The Downtown Review

Since music became easily accessible through technological advances, the industries progression has been largely dictated by the preferences of middle-class, adolescent Caucasians. When bearing this in mind, the prevalence of pop music that was either made or inspired by African American influences, particularly from an urban setting, or that invokes the persona of the white, suburban "rejects", like Nirvana, becomes an interesting inquiry. This article charts how both members and pretenders of the seemingly unpopular subgroups of black "ghetto" city-folk and awkward, friendless scruffy white males has led to some of the most critically-acclaimed and popularly adored genres of music …

Comparing Beijing's And Tokyo's Population Growths, Ernest M. Oleksy Dec 2018

Comparing Beijing's And Tokyo's Population Growths, Ernest M. Oleksy

The Downtown Review

The growth of the human population has led to the formation of largely populated agglomerations known as megacities. Although megacities can be found on multiple continents, Asia’s collection displays how megacities can develop in their own directions. Japan’s megacity of Tokyo, like other Japanese megacities, has adopted a western approach. China’s Beijing, on the other hand, continues to embrace its eastern roots. These megacities may differ in their ideologies, but they share in experiencing similar phenomena. One of these phenomena is population growth.

Inequality, Rubber, And Thermodynamics In Indonesia, Ernest M. Oleksy Dec 2018

Inequality, Rubber, And Thermodynamics In Indonesia, Ernest M. Oleksy

The Downtown Review

Intersectionality has led the charge in ensuring that workplace justice is assured to all people, irrespective of their identities. While intersectionality is a useful theory for explaining inequality, what must not be understated is the contributions that postcolonialism and the blue-collar working identity can have on harsh working conditions. Particularly, miners in Indonesia have had to work in very hostile environments where they are at-risk for sulfur poisoning as they mine for materials to vulcanize rubber. This article serves two purposes. The first is to call attention to how place can help explain the differential experiences of miners in the …

The Chemical Causes And Social Effects Of Acid Rain, Ernest M. Oleksy

The Downtown Review

While global warming tends to dominate the collective conscious for environmentalism of academics and the public alike, many other physical phenomena bear serious implications for humanity's future. One such phenomenon, acid rain, has been under-reported considering how damaging it is to the ecosystem and how much politicking is involved when determining how to address it. This article serves two purposes. The first is to inform readers of the basic chemical processes underlying acid rain and why it is damaging to organisms. The second is to inform readers of how acid rain has been portrayed by other publications, like the National …

Daniel Webster Presidential Campaign Broadside, Ernest M. Oleksy Dec 2018

Daniel Webster Presidential Campaign Broadside, Ernest M. Oleksy

The Downtown Review

A picture is worth a thousand words. When it comes to learning about history, a strong image can engage students in thinking about the way society operated better than reading a chapter out of a history book. This broadside is a creative design used not to imply that Daniel Webster had a presidential campaign flyer similar to it, but rather as an artistic re-imagining of what campaigning was like in 19th century U.S.A. This broadside serves two purposes. The first is as a creative expression and artistic venture. The second is as a rough approximation to traditional broadsides so that …

An Examination Of The Death Penalty, Alexandra N. Kremer Dec 2018

An Examination Of The Death Penalty, Alexandra N. Kremer

The Downtown Review

The death penalty, or capital punishment, is the use of execution through hanging, beheading, drowning, gas chambers, lethal injection, and electrocution among others in response to a crime. This has spurred much debate on whether it should be used for reasons such as ethics, revenge, economics, effectiveness as a deterrent, and constitutionality. Capital punishment has roots that date back to the 18th century B.C., but, as of 2016, has been abolished in law or practice by more than two thirds of the world’s countries and several states within the United States. Here, the arguments for and against the death …

“A New Way Of Thinking”: Frantz Fanon’S True Opinion On Violence, Caroline D. Renko Dec 2018

“A New Way Of Thinking”: Frantz Fanon’S True Opinion On Violence, Caroline D. Renko

The Downtown Review

In an attempt to clear Frantz Fanon’s name, on account of his opinion on the role of violence in decolonizing a nation, this paper focuses on two important chapters in his last book, The Wretched of the Earth. By closely reading his articulation of the Algerian war and the wounds brought on by mental illness at such a time, Fanon’s true opinion concerning violence becomes clear. For too long, he has been seen and used as a proponent for inciting violence, but this is a misconception that has been perpetuated by devaluing the importance of his descriptions of the …

An Analysis Of Peer-Assessment In Chinese As A Second Language Classroom Presentation, Lu Lu

Chinese Language Teaching Methodology and Technology

This study aims to 1) investigate the difference in the scorings between PA and teacher assessment in oral presentation, and 2) explore student’s attitude about PA through both quantitative and qualitative approaches. A class of 12 students in an upper-intermediate Chinese language class adopted PA by using Poll Everywhere during an academic year. The results indicate that intermediate-high Chinese learners and instructor interpret the criteria differently in Pronunciation, Fluency, Clarity, and Accuracy, but agree with the scores on Content and Delivery. Workplace Privacy In The Age Of Social Media, Tess Traylor-Notaro

Global Business Law Review

This note addresses the lack of adequate protections in Ohio for social media privacy laws in the workplace and compares proposed legislation in Ohio to legislation that has passed in other states. It examines the provision of the SCA including the definition of "user" and whether social media sites fall under its umbrella. It also looks at the safeguards and limitations of the SCA and how it is used to protect a private employee’s social media account. It analyzes the state statutory laws in Arkansas, Illinois, and California passed specifically to prevent employers from requesting passwords to personal Internet accounts. …

Agribusiness And Antitrust: The Bayer-Monsanto Merger, Its Legality, And Its Effect On The United States And European Union, Aleah Douglas

Global Business Law Review

This note examines the current and historical antitrust laws of the United States and the European Union as they relate to the currently pending merger between Bayer and Monsanto. It focuses alternatively on the legality of the merger under modern antitrust laws and the impact such a deal could have on the agribusiness industry in both Europe and the United States. Ultimately, the note argues that the Bayer-Monsanto merger is illegal and should be blocked by the proper authorities in the United States and the European Union.

Personal Jurisdiction Over Orb-Web Corporations: A Re-Routed Approach For "Change In The Navigation Of Time", Vidhya Iyer Jul 2018

Personal Jurisdiction Over Orb-Web Corporations: A Re-Routed Approach For "Change In The Navigation Of Time", Vidhya Iyer

Global Business Law Review

The law of personal jurisdiction lies at the heart of all litigation. Our courts must recognize the rights of individuals as well as the rights of corporations. The motto placed at the entrance of the United States Supreme Court—"Equal Justice Under Law"—ensures the promise of equal justice under the law to all persons. It expresses the ultimate responsibility of the Supreme Court of the United States (the "Court") as the highest tribunal for all cases and controversies arising under the Constitution, laws, and treaties of the United States and functions as a guardian and interpreter of the Constitution. From the …

Making Sense Of The European Union's Vat Tax System: Does The European Court Of Justice's Jurisprudence Support Harmonization?, Jarrod Tudor Jul 2018

Making Sense Of The European Union's Vat Tax System: Does The European Court Of Justice's Jurisprudence Support Harmonization?, Jarrod Tudor

Global Business Law Review

The Sixth Council Directive 77/388/EEC was adopted by the European Union (EU) as a means toward harmonization of the value-added tax (VAT) system. The Framers of Directive 77/388/EEC believed that a disjointed VAT tax system that existed previously was harmful to the common market’s guarantee of free movement of goods and services that are subject to the VAT tax. The jurisprudence of the European Court of Justice (ECJ) on the subject of the Sixth Council Directive 77/388/EEC reflects four dominant patterns, including the limitation of member-states to dictate the parameters of the VAT tax, that additional administrative measures cannot be …

Tipped Scales: A Look At The Ever-Growing Imbalance Of Power Protecting Religiously Motivated Conduct, Why That's Bad, And How To Stop It, Jeff Nelson

Cleveland State Law Review

This Note examines the current state of the law that seemingly allows individuals to harm and discriminate against others on the basis of their protected religious beliefs. This Note also explores how such a result has been made possible and how it may be stymied by judicial and legislative action. Section II discusses a short history of the First Amendment’s Free Exercise Clause leading up to Religious Freedom Restoration Acts, and also includes an examination of both the real and possible harmful effects of RFRAs, current reactions to the application of these laws domestically, and interesting parallels internationally. Section III …
