Nation As Partnership: Law, "Race," And Gender In Aotearoa New Zealand's Treaty Settlements, Nan Seuffert
Nation As Partnership: Law, "Race," And Gender In Aotearoa New Zealand's Treaty Settlements, Nan Seuffert
Professor Nan Seuffert
This article uses postcolonial theory to analyze the dynamic convergence of two significant international trends in Aotearoa New Zealand: the movement for reparations for historical colonial injustices, and the economic reform process known as ‘‘structural adjustment,’’ or Reaganomics in the United States, which was intended to produce a competitive nation of individual entrepreneurs. It argues that analysis of the interrelationships of law, ‘‘race,’’ gender, and nation in this convergence illuminates the reproduction and reshaping of colonial tropes, or historical racial configurations produced through colonization, in these current trends. In Aotearoa New Zealand, claims by indigenous Maori activists for self-determination and …

This third edition of Criminal Laws continues and extends the features that made the second edition the leading tertiary criminal law teaching and resource book in NSW and the ACT, highly influential in other states, and a must for practitioners working in criminal law.It combines: key primary materials for students, in the form of the leading cases and statutes; extracts from secondary literature, which provide context and commentary from a range of perspectives and disciplines; and extensive critical commentary by the authors.Criminal law is approached as a mode of regulation with specific limits, and a sceptical attitude is maintained to …

Brown, Farrier, Neal And Weisbrot's Criminal Laws: Materials And Commentary On Criminal Law And Process Of New South Wales, David Brown, David Farrier, Sandra Egger, Luke Mcnamara
Luke McNamara
The success of Criminal Laws lies both in its distinctive features and in its appeal to a range of readerships. As one review put it, it is simultaneously a "textbook, casebook, handbook and reference work". As such it is ideal for criminal law and criminal justice courses as a teaching text, combining as it does primary sources with extensive critical commentary and a contextual perspective. It is likewise indispensable to practitioners for its detailed coverage of substantive law and its extensive references and inter-disciplinary approach make it a first point of call for researchers from all disciplines. This fourth edition strengthens these …

Guestworker Programs: Lessons From The Past And Warnings For The Future, Vernon Briggs

"Immigration policy is a minefield of controversial issues, and among the most explosive are those programs that permit low-skilled foreign nationals to work in the same labor market as U.S. citizens and permanent resident aliens. Because such endeavors have been undertaken in the past, they have a track record and have been subject to extensive research. There is no need to speculate about what might happen if any new such venture – such as that proposed by the Bush Administration on January 7, 2004 – were to be enacted. The outcome is easily predicted."

American Unionism And U.S. Immigration Policy, Vernon Briggs
American Unionism And U.S. Immigration Policy, Vernon Briggs
Vernon M Briggs Jr
"Throughout its lengthy history, few issues have caused the American labor movement more agony than immigration. It is ironic this should be the case as most adult immigrants directly enter the labor force. So eventually do most of their family members. But precisely because immigration affects the scale, geographical distribution, and skill composition of the labor force, it affects national, regional, and local labor market conditions. Hence, organized labor can never ignore immigration trends. Immigration has in the past and continues to affect the developmental course of American trade unionism. Labor's responses, in turn, have significantly influenced the actual public …

Employer Sanctions And The Question Of Discrimination: The Gao Study In Perspective, Vernon Briggs
Vernon M Briggs Jr
"The enactment of the Immigration Reform and Control Act of 1986 (IRCA) produced the most extensive legislation in the area of employment law in the United States in two decades (i.e., since the adoption of the Occupational Health and Safety Act of 1970). Its provisions affect every employer and every job seeker since the law went into effect on November 6, 1986. Among its multiple provisions were strictures designed to prohibit employers from hiring illegal immigrants. This action had the effect of repealing the 'Texas Proviso' of the Immigration and Nationality Act of 1952 that specifically exempted the employment relationship …

At A Crossroad: Immigration Reform And American Unionism, Vernon Briggs
Vernon M Briggs Jr
"Since the founding days of the Republic, the relationship between American unionism and mass immigration has been contentious. No issue has caused the labor movement more agony and irony. It is no surprise, therefore, that throughout its history the American labor movement has sought to influence U.S. immigration policy."

Best Practices For Drafting University Technology Assignment Agreements After Filmtec, Stanford V. Roche, And Patent Reform, Parker Miles Tresemer

Since the end of World War II, federally funded universities and private companies have been an integral part of continued American innovation and technological production. However, like most rational economic actors, universities and private companies are only willing to invest in federally funded technologies if they are guaranteed some sort of exclusive return on their investment. By granting federal contractors exclusive patent rights to their employee’s federally funded inventions, the Bayh-Dole Act provided the necessary incentives for private sector investment in federally funded technologies. However, case law subsequent to Bayh-Dole’s enactment has significantly undermined the system of incentives Congress intended …

"Law's Outsiders": An Interview With Alex Sharpe, Linnéa Wegerstad, Niklas Selberg
Linnéa Wegerstad
In May 2012 Alex Sharpe, Professor of Law at Keele University, UK, visited Lund University where she participated in a series of seminars and workshops organised around a central motif in her work: the legal outsider. As part of her visit she presented a version of a paper recently published in the Modern Law Review titled “Transgender Marriage and the Legal Obligation to Disclose Gender History.” The paper focused on and challenged the legal and wider cultural framing of non-disclosure of gender history as harmful and as unethical. The paper is her latest intervention and forms part of a substantial …
