Occupying The Constitutional Right To Housing, Lisa T. Alexander

The United States (U.S.) does not recognize a formal legal right to housing. Yet, the right to housing is alive in America. Using qualitative interviews and case studies, this article is the first to argue that recent housing rights movements in the U.S., such as the Occupy movements, instantiate a constitutional right to housing in America through private ordering and local law reform, rather than through constitutional adjudication or federal and state legislation. These social movements manifest the right to housing in America when they mobilize through online social networks; occupy and retain vacant and real estate-owned homes; defend home …

The Causes Of Teacher Burnout And Attrition, Kierstin Nygaard

Kierstin Nygaard

Teacher burnout is a reason why teachers leave the teaching profession. Relationships, working conditions, teacher self-efficacy, and years of experience all have an impact on teacher burnout. Qualitative, quantitative, and mixed-method studies of teachers found that teacher burnout can developed and be alleviated. Findings suggest that teachers who lack support from their principals and colleagues are more likely to develop teacher burnout. Results also indicate that new and veteran teachers develop burnout and work to relieve their burnout in different ways. Working in an environment where teachers feel supported can lead to teacher fulfillment and the prevention of burnout.

Because of their inexperience, emerging adults often have a difficult time navigating healthy romantic relationships.  For many, the skills necessary for quality relationships are usually learned through parents, friends, or mentors. Foster youth, in particular, may struggle more in developing and sustaining romantic relationships due to the lack of or inconsistent parental guidance or mentoring. To address this, I have created a two hour lesson for emerging adult foster youth attending Hartnell College in Salinas, California. Notwithstanding the absence of explicit constitutional protections for corporations within the organic documents of the United States, the Supreme Court has extended constitutional protections to corporate entities in a variety of contexts. Nevertheless, the Court has, to date, failed to articulate a particular, unifying framework for adjudicating corporate constitutional rights. Thus, the Court’s extant jurisprudence provides no framework for explaining the panoply of existing corporate constitutional rights, distinguishing extended constitutional rights from those which corporations cannot exercise, or prospectively adjudicating the extension of constitutional rights to incorporated entities. Abstract (Stark & Choplin) The authors explored the reasons why judges too often fail to see the likelihood of future violence—the wrecking ball in motion—when petitioners request ex parte orders of protection in domestic violence cases. One reason is that the dynamics of domestic violence are very different from the dynamics at play in other situations wherein petitioners request emergency ex parte orders. Another reason is that the dynamics of domestic violence are counterintuitive and judges often do not understand them. Given the complex multidirectional global flows of programming that mark the current era, we must interrogate the power dynamics at play when American programming is translated for foreign audiences. I do so in this project using the Latin American dub of the U.S. television series Glee as a case study. Beyond comparing and contrasting Glee and its Latin American dub, this project has two primary interventions within the field of global television studies. This division is particularly evident when it comes to oversight of nonprofit organizations. The historical focus of federal government oversight has been limited primarily to qualification for tax exemption and other tax benefits, with more plenary power resting with state authorities. Recent publicity over enormous estimates of “missing” wealth and the use of sophisticated tax strategies by companies like Apple, Google, and Starbucks have produced a demand that the wealthy pay a “fair” amount of tax regardless of their compliance with the letter of tax laws. In particular, the Tax Justice Network’s claim that $21-$32 trillion of “hidden” wealth remains untaxed has garnered considerable attention. In this paper we argue that these claims rest on poor data and analysis and mistakes about how financial transactions work. This article presents an alternate theory of fair use, employing social semiotics as a process theory of meaning-making to frame the transformativeness inquiry. It is an argument for an expansion of fair use based not on theories of authorship or rights of autonomy, but rather a theory of the audience linked to social practice. In Don Quixote II the multiple food episodes revolve around Sancho Panza who experiences and discusses the changing face of Spain's gastronomy. From simple peasant food to elaborate noble banquets, from a village wedding celebration to spontaneous roadside meals, and from detailed food preparations to post prandial conversations, the visceral Sancho experiences fully sensual pleasures of consumption. Characters in the novel, specifically Don Quixote and the doctor Pedro Recio who attends to Sancho while governor of Barataria, reveal cultural assumptions that consuming certain foods was a sign of social identity and maintained proper social equilibrium. This chapter, written for a foreign audience unfamiliar with U.S. constitutional law, traces the history of the development of asset forfeiture law in the United States from the 18th Century to present, with focus on the constitutional issues that had to be resolved by the U.S. Supreme Court. A similar study appears as Chapter 2 of the author's treatise Asset Forfeiture Law in the United States.
