Occupying The Constitutional Right To Housing, Lisa T. Alexander

The United States (U.S.) does not recognize a formal legal right to housing. Yet, the right to housing is alive in America. Using qualitative interviews and case studies, this article is the first to argue that recent housing rights movements in the U.S., such as the Occupy movements, instantiate a constitutional right to housing in America through private ordering and local law reform, rather than through constitutional adjudication or federal and state legislation. These social movements manifest the right to housing in America when they mobilize through online social networks; occupy and retain vacant and real estate-owned homes; defend home …

In Japan, the services that maintain the television reception and recording device for the overseas viewers to watch the aired television programs over the Internet were accused of as infringing the copyrights of the broadcasting companies. The judgments of the Supreme Court of Japan in copyright infringement suits against these services holding them liable significantly expanded the scope of right of reproduction and right of public transmission. These judgments are surely a blessing for copyright holders. A Unified Framework To Adjudicate Corporate Constitutional Rights, Jonathan A. Marcantel

Notwithstanding the absence of explicit constitutional protections for corporations within the organic documents of the United States, the Supreme Court has extended constitutional protections to corporate entities in a variety of contexts. Nevertheless, the Court has, to date, failed to articulate a particular, unifying framework for adjudicating corporate constitutional rights. Thus, the Court’s extant jurisprudence provides no framework for explaining the panoply of existing corporate constitutional rights, distinguishing extended constitutional rights from those which corporations cannot exercise, or prospectively adjudicating the extension of constitutional rights to incorporated entities. "Seeing The Wrecking Ball In Motion: Ex Parte Protection Orders And The Realities Of Domestic Violence", Debra P. Stark, Jessica M. Choplin

Abstract (Stark & Choplin) The authors explored the reasons why judges too often fail to see the likelihood of future violence—the wrecking ball in motion—when petitioners request ex parte orders of protection in domestic violence cases. One reason is that the dynamics of domestic violence are very different from the dynamics at play in other situations wherein petitioners request emergency ex parte orders. Another reason is that the dynamics of domestic violence are counterintuitive and judges often do not understand them. Because judges do not understand these dynamics, they often misapply assumptions (called cognitive schemas and scripts) from other domains …

Recent publicity over enormous estimates of “missing” wealth and the use of sophisticated tax strategies by companies like Apple, Google, and Starbucks have produced a demand that the wealthy pay a “fair” amount of tax regardless of their compliance with the letter of tax laws. In particular, the Tax Justice Network’s claim that $21-$32 trillion of “hidden” wealth remains untaxed has garnered considerable attention. In this paper we argue that these claims rest on poor data and analysis and mistakes about how financial transactions work. This chapter, written for a foreign audience unfamiliar with U.S. constitutional law, traces the history of the development of asset forfeiture law in the United States from the 18th Century to present, with focus on the constitutional issues that had to be resolved by the U.S. Supreme Court. A similar study appears as Chapter 2 of the author's treatise Asset Forfeiture Law in the United States.
