This presentation presents preliminary research findings of a study on the nature and extent of police crime in the United States. It provides information on the factors that influence how a law enforcement agency responds to arrests of its officers. The data indicate that civil rights litigation is a correlate of police misconduct.

This study is a quantitative content analysis of news reports and court records on 3,328 violence-related arrest cases of 2,586 individual sworn law enforcement officers during the years 2005-2011. The arrested officers were employed by 1,445 nonfederal state, local, special, constable, tribal, and regional law enforcement agencies located in 805 counties and independent cities in 49 states and the District of Columbia. Binary logistic regression and classification and regression tree (CART) analyses were conducted to predict criminal conviction in violence-related police crime arrest cases. Finding indicate that conviction of police officers on one or more offenses charged are driven by …

Police officers acting in their official capacity are subject to being sued in federal court pursuant to 42 U.S.C. §1983 for violating constitutional rights under the color of law. Using data obtained in a larger study on police crime in the United States, names of more than 5,500 nonfederal sworn law enforcement officers who were arrested during the years 2005-2011 were checked against the civil case party master name index of the federal courts’ Public Access to Courts Electronic Records (PACER) system. Findings indicate that more than 20% of the police officers who were arrested for committing one or more …

This report was prepared at the request of the California Research Bureau. The data are from a larger study on police crime in the United States. Police crimes are those crimes committed by sworn law enforcement officers given the general powers of arrest at the time the offense was committed and/or at the time when the officer was arrested. These crimes can occur while the officer is on- or off-duty and include offenses committed by state, county, municipal, tribal, or special law enforcement agencies. Officer-involved domestic violence is a problem that should concern researchers, policymakers, the policing community, and the general public. Yet there is very little research in the area and no official data is available to discern the nature and prevalence of domestic violence in police families. Victims are reluctant to report officer-involved domestic violence and often feel helpless in the criminal justice system where the abuser is employed. This is complicated by provisions of the Lautenberg Amendment of 1996 which prohibit anyone convicted of a crime of domestic violence from carrying a firearm. This essay examines the criminological conceptualizations and research on police crime, that is, the criminal behavior of sworn law enforcement officers. It starts with an overview of the conceptualization of police crime as it relates to organizational and scholarly perspectives of social deviance. Police deviance is often conceptualized to include various misconduct, corruption, and/or crime committed by police organizations and police officers. Police sexual misconduct is often considered a hidden crime that routinely goes unreported. The current study provides an empirical data on cases of sex-related police crime at law enforcement agencies across the United States. The study identifies and describes incidents where sworn law enforcement officers were arrested for one or more sex-related crimes through a quantitative content analysis of published newspaper articles and court records. The primary news information source was the Google News search engine using 48 automated Google Alerts. School resource officers (SROs) have become a permanent presence in many K-12 schools throughout the country. As a result, an emerging body of research has focused on SROs, particularly on how SROs are viewed by students, teachers, and the general public. This exploratory and descriptive research employs a different focus by examining the nature of crimes for which SROs were arrested in recent years with information gathered from online news sources. This study explores and describes the nature and character of cases that involve the criminal misuse of TASERs by police officers through a content analysis of newspaper articles. The news-based content analysis identified 24 police officers who were arrested for crimes that involved inappropriate use of TASERs over a 65 month period from January 2005 through May 2010. Data on these cases are presented in terms of: a) the arrested officer, b) victim characteristics, and c) the situational context of these events. The current study explores criminal conduct by policewomen. This information is increasingly relevant as police departments hire more women, especially if the crimes committed by policewomen differ from those of policemen. News searches identified 105 cases depicting arrests of policewomen. A content analysis was performed. Findings indicate differences exist between crimes committed by policemen and policewomen, as well as by policewomen and women in general. Crime by policewomen is most often profit-motivated. Policewomen had fewer years of service and lower ranks, committed less violent crimes, and were more likely to receive suspensions for off-duty crimes compared to their male peers.

There are no exhaustive statistics available on the crimes committed by law enforcement officers, and only a small number of studies provide specific data on police crimes. The purpose of the current study is to examine the character of police arrests known to the media. Cases were identified through a content analysis of news coverage using the internet-based GoogleTM News search engine and its Google News Alerts search tool. The study focuses on the crimes committed by experienced officers who are approaching retirement. The findings of independent commissions and research derived from a data-set of career-ending misconduct among New York Police Department (NYPD) officers suggests that police engage in a wide variety of crimes while they are off-duty including domestic violence, bar fights, drunk driving, burglary, and sex offenses (The Mollen Commission, 1994; Fyfe & Kane, 2006; Kane & White, 2009). The off-duty misbehavior of police is an important concern for police agencies exposed to potential liability costs, and scholars engaged in debates about whether studies on police deviance should include acts committed while an officer is technically off-duty. The purpose of the current study is to provide empirical data on cases of police driving under the influence (DUI) of alcohol and/or drugs. It identifies events that may have influenced the decision to arrest, including associated traffic accidents, fatalities, officer resistance, the refusal of field sobriety tests, and the refusal of blood alcohol content (BAC) tests. The study is a quantitative content analysis of news articles identified through the Google News search engine using 48 automated Google Alerts queries.
