On June 24, 1976, the Supreme Court of the United States decided the case of National League of Cities, et al. v. Usery, Secretary of Labor. The League and a number of cities and states had challenged the validity of the 1974 amendments to the Fair Labor Standards Act extending the Act's minimum wage and maximum hours provisions to almost all employees of states and their political subdivisions.

William J. Haynes, Jr., Assistant Attorney General, issued Opinion No. 119 on May 22, 1975. Because of this opinion it now appears that a municipality may use State Street Aid revenue to pay the electric bills for street lighting. While James K. Polk’s administrative record as governor of Tennessee from 1839 to 1841 has been over shadowed by the more interesting partisan bickering of the era, his term in office saw continued legislative activity in the areas of banking, internal improvements and education. Throughout his single-term as governor, Polk was interested more in national affairs and was satisfied to correct abuses rather than to pursue new initiatives.
