On August 17, 2000, the Department of Health and Human Services (HHS) adopted uniform national standards for electronic health transactions and code sets pursuant to the Administrative Simplification provisions of the Health Insurance Portability and Accountability Act of 1996 (HIPAA). Uniform standards hold the promise of improved efficiency in the health care system through standardized electronic transmission of health information.
Many behavioral health care organizations (e.g., the American Psychiatric Association, the National Association of State Mental Health Program Directors, and the National Association of State Alcohol/Drug Abuse Directors) have argued that the Rule's standards are insufficient for behavioral health providers. …

[Excerpt] "A variety of commodities, from chlorine to corn and petroleum to passengers, are transported on the lower Mississippi River regularly. Corn, wheat and coal are the most commonly carried commodities. From a human health and safety perspective, these are relatively benign products in that a vessel accident and spill of these are not directly hazardous to people, whatever other ecological disturbances may ensue. However, over eighty million tons of petroleum products are transported on the river annually. Over a million tons of liquid natural gas traverse the river through the center of New Orleans. Legal systems across the globe have attempted to accommodate to our new understandings of human behavior, evolving notions of fairness, and increasing recognitions by Western jurists that the law sits within, not apart from, the complexities of societies. One manifestation of legal system change has been the attempt to alter legal institutional structures and practices in order to better address the overlap of justice and social concerns, often drawing from culture contexts previously ignored by Western bureaucracies (see, e.g., Levine, 2000, discussing the Maori roots of family group conferencing practices). This paper presents the results of a posthumous, indirect assessment of the personality of Mohamed Atta, apparent ringleader in the September 11, 2001 terror attack on the World Trade Center and the Pentagon, from the conceptual perspective of Theodore Millon.
Information concerning Mohamed Atta was collected from media reports in the one-month period following the attack and synthesized into a personality profile using the second edition of the Millon Inventory of Diagnostic Criteria (MIDC), which yields 34 normal and maladaptive personality classifications congruent with Axis II of DSM-IV.
The personality profile yielded by the MIDC was analyzed on the …

This paper presents the results of an indirect assessment of the personality of Osama bin Laden, founder and leader of the al-Qaida terrorist network responsible for the September 11, 2001 terrorist attack on the United States.
Bin Laden’s primary personality patterns were found to be Ambitious/exploitative and Dauntless/dissenting, with a secondary Distrusting/suspicious orientation, and subsidiary Dominant/controlling and Conscientious/dutiful features.
Ambitious individuals are bold, competitive, and self-assured; they easily assume leadership roles, expect others to recognize their special qualities, and often act as though entitled. Dauntless individuals are bold, courageous, and tough; minimally constrained by the norms of society; routinely engage …

As the Latino population in Massachusetts continues to grow, there has been a corresponding increase in the number of Latinos achieving elected office throughout the state. Twenty years ago there was only one Latino serving in elected office in Massachusetts—Nelson Merced. In 1995, there were only four elected officials who were Latino and no state representatives. Today, through the hard work of candidates, activists, and Latino community activists and organizations, there are three Latinos serving as state legislators, fourteen holding municipal office, and an increasing number of campaigns at all levels of municipal and state government being conducted.

Throughout the 1990s the United Nations Human Development Index, an annual report that measures human development, depicted Sierra Leone as one of, if not the poorest nation on the planet. In 2001, the same report depicted 162 countries in terms of human development and Sierra Leone ranked 162. This Sub-Saharan nation experienced a total collapse of its state and society beginning in 1990. The United Nations and the rest of the international community are only now beginning to work towards putting Sierra Leone together again.

Countries going through democratic transition have to address how they will deal with the human rights crimes committed during the authoritarian era. In the context of amnesty for perpetrators, truth commissions have emerged as a standard institution to document the violent past. Increasingly, claims are made that truth commissions have beneficial psychological consequences; that is, that they facilitate 'catharsis', or 'heal the nation', or allow the nation to 'work through' a violent past. This article draws upon trauma counseling experience and anthropological fieldwork among survivors to challenge these claims in the context of the South African Truth and Reconciliation Commission. …

This issue brief, prepared by the George Washington University Center for Health Services Research and Policy (CHSRP), presents an analysis of a sample of contractual agreements entered into by State Departments of Corrections with managed care organizations (MCOs) for the provision of managed behavioral health care services in State prisons. It is part of a series of contract studies undertaken by CHSRP that examine the implications of managed care contracting by public and private sector purchasers for the financing and delivery of behavioral health care services.

In November 2000, the University of Nebraska Public Policy Center (PPC) and the University of Nebraska-Lincoln Center on Children, Families and the Law (CCFL) entered into a partnership with the Lincoln/Lancaster County Joint Budget Committee (JBC) and United Way of Lincoln/Lancaster County (UW). The purpose of this University-Community partnership has been to facilitate implementation of the Lincoln/Lancaster County Human Services Three-Year Comprehensive Plan (Plan). Through citizen initiative in 1993, Maine passed a term limits bill that now prevents legislators with eight years of consecutive service from seeking reelection. Although touted as a means of eliminating careerism in public service and as a means of bringing fresh blood and new policy initiative to Augusta, many now question whether limits on service have hampered legislative efficiency through the loss of experienced leadership and institutional memory. Moen and Palmer examine the impact of term limits on the legislature’s standing committees. While noting adverse impacts such as heavier workloads, they also find an institution hard at work to …

Throughout American history, we have grappled with the problem of balancing liberty versus security in times of war or national emergency. Our history is littered with sordid examples of the Constitution's silence during war or perceived national emergency. The Bush Administration’s War on Terror has once again forced a reckoning requiring Americans to balance liberty and national security in wartime. President Bush has stated, "[w]e believe in democracy and rule of law and the Constitution. The War On Terrorism And The End Of Human Rights, David Luban

In the immediate aftermath of September 11, President Bush stated that the perpetrators of the deed would be brought to justice. Soon afterwards, the President announced that the United States would engage in a war on terrorism. The first of these statements adopts the familiar language of criminal law and criminal justice. It treats the September 11 attacks as horrific crimes—mass murders—and the government’s mission as apprehending and punishing the surviving planners and conspirators for their roles in the crimes. The War on Terrorism is a different proposition, however, and a different model of governmental action—not law but war. Most …
