Symbolism and substance are essential parts of any political system. In our system of government, we typically think of symbolism as serving substantive ends. Using a triangulation of _methods (Participant Observation, Archival Data, and Documentary Evidence), the paper examines two cases (Social Security and criminal justice) and concludes that the mix between substance and symbolism has changed dramatically in recent years with symbolism now assuming the central role.
The current debates over Social Security funding and criminal justice sanctions, for example, are less about the concerns of old-age security or making the public safer as much as they reflect a …

In 1996 the job classification of Process Server was created in the Clark County District Attorney Criminal Division in Las Vegas, Nevada. It was implemented by DA Stewart L. Bell as a cost-saving measure meant as a reclassification of the position of Investigator. Since the initial job posting, the duties appropriate to the position of Process Server have been and remain in question. No written, measurable job performance standards have been established and no consistent training or supervision provided. A review of the literature suggests wide variance in what may be considered appropriate job duties for this classification, though the …

The emotional impact of a shooting incident on the individual police officer has been recognized and detailed by both police and mental health professionals (Lippert & Ferrara, 1984). The human cost and financial costs to Police Departments as a result of "post shooting" trauma has sensitized many departments to the need for professional support for officers involved in shootings. Recent survey research has provided information about the percentage of officers who experienced great, moderate, or no emotional impact after being involved in shootings (Stratton, 1982). The study focuses on the issue of establishing a citizen review board at the Las Vegas Metropolitan Police Department (LVMPD) for the purpose of reviewing allegations of misconduct. With the recent increase of police officer misconduct the LVMPD has come under a great deal of scrutiny by residents of the community. The credibility of the department has been jeopardized as a result of the current complaint investigations process which is conducted by the Internal Affairs Bureau. In August 1998 a comprehensive national survey added to the growing mass of information on how the public perceives the state courts. The “Perceptions of the U.S. Justice System,” commissioned by the American Bar Association, relied on telephone interviews of 1,000 American adults selected at random. The respondents were asked for their opinions about “the justice system,” lawyers, judges, law enforcement and the courts. The findings from the ABA survey were optimistic relative to most of the previous surveys. Public confidence in the courts relative to other major institutions seemed higher, and experience with courts appeared to promote higher rather …

In 1979, the Islamic Republic of Iran emerged on the international stage and began to establish itself as a participant in global terrorism. Throughout the period 1979-96, officials linked numerous terrorist actions and operations to Iran; this link could have involve Iran's direct sponsorship or indirect involvement, such as by providing monetary support to operatives. In order to develop strategies to prevent or minimize the threat of terrorist attack, Iran's role in global terrorism must be assessed.

This research analyzes local TV news coverage of three Nebraska executions in the 1990s, the first in the state since 1959. The three Nebraska executions allow us to see mass media coverage of the death penalty from four perspectives: 1) media organization routines, journalistic beliefs, and how source selection affected the content; 2) justice was portrayed through a consonant set of social symbols; 3) the public support for the death penalty in this country may have led journalists to avoid tough questioning of public officials; 4) the resulting coverage was a social construction of reality that might influence future public …

Judicial Decision Making Under Michigan Sentencing Guidelines, Abel E. Ekpunobi

Many states and the federal judiciary have adopted sentencing guidelines as a mechanism of sentencing reform. This study used the bounded rationality model to investigate judicial decision-making under Michigan Sentencing Guidelines, and the effectiveness o f the guidelines in reducing or eliminating sentencing disparities — situations in which legally similar defendants receive dissimilar sentences.
A statistical and comparative analysis of a database sample of felony cases (n = 20,834), sentenced in four different-sized Michigan counties from 1992 through 1997, was examined with logistic and linear regression models. Logistic regression results indicate a significant association (p < .05) between incarceration and some legal and extralegal variables. Legal variables, such as prior felony convictions, sentencing guideline scores, offense type/severity, the defendant’s relationship with the criminal justice system, and extralegal variables, such as the defendant’s race and gender, year and county of sentencing, are important predictors of sentencing outcomes. Linear regression results indicate a significant association (p < .05) between the minimum term of imprisonment and prior felony convictions, sentencing guidelines and offense type/ severity, but not with extralegal variables. These results suggest that judicial decision-making remains a human/“bounded rationality” process.

This study examines the most important management roles, as viewed by Adult Protective Services supervisors and Adult Protective Services staff members in Region 11. A total of 6 supervisors and 51 staff members were mailed questionnaires on October 1, 1998. A total of 5 supervisors and 26 staff members completed and returned the questionnaires.
The study is limited by a lack of a consistent management role theory, limited to a basic method of aggregation, and limited to a specific population.
APS supervisors were found to believe the management roles of leader, monitor and disturbance handler as being most important to …

Losses to corporations and governmental agencies have totalled millions if not billions of dollars per year. Victims are beginning to speak out and ask for help. Law enforcement agencies throughout the country are teaming together to create specialized crime units and task forces in an attempt to successfully combat computer related crimes. Mental health parity legislation could substantially reduce the degree to which financial responsibility for the treatment of mental illness is shifted to government, especially state and local government. There is substantial evidence that both mental health and addictions treatment is effective in reducing the utilization and costs of medical services. There appears to be a lack of substantial evidence to discourage Florida from pursuing mental health and substance abuse parity legislation.

Using Selective Mmpl-2 Clinical Scales To Predict The Severity Of Prison Infractions For First Degree Murderers In A Maximum Security Prison, Margarita Lynn Pauley

The MMPI-2 was administered to 56 adult male offenders in a maximum-security prison serving a life sentence for first degree murder. This study evaluated the predictive ability of the MMPI-2 scales 4, 6 and 9 to distinguish among groups of inmates with high and low infraction rates. Results indicated that as the weighted infraction rate (WRI) increased above 9, the T score on scale 4 sharply decreased at the same rate of the increase for 0-9 WRI. Results also supported a relationship where as the T score on scale 9 increased the WIR also increased. Inmates who refused to comply …

The aim of this research was to study the background of boys referred to an assessment centre by the juvenile courts, and to look in particular at the area of educational history. More specifically the study sought to ascertain young offenders own perceptions of education. The research was carried out in a number of phases: Phase one consisted of the accumulation of baseline data on the backgrounds of young offenders in Ireland through the analysis of the files held in a juvenile assessment centre.
