Zoning Ordinances And "Free Speech", Alan C. Weinstein

Law Faculty Articles and Essays

Over the past two decades there has been a marked expansion in legal challenges to local land use regulations claiming violations of the free speech clause of the First Amendment to the United States Constitution. First Amendment claims can arise whenever government enacts or enforces zoning or other regulations that deal with uses such as billboards or adult entertainment businesses. This article discusses why this litigation is taking place, provides an overview of First Amendment law, and offers local officials some guidelines to help avoid potential legal challenges.

The accident occurred at 10:45 on December 24th 1999 during the manual demining of power lines between Maputo and Komatiport at the 88th tower about 8km from Moamba Town. The deminer was injured in an area considered to be densely mined during an attempt to enlarge the cleared area from 20 square metres to 40 square metres. While trying to cut some shrubs he made a "false move" and activated a mine outside his lane with his left foot. The mine was outside the "ring" and below a tree.

The demand for a centralized lessons learned database has made it clear that there is value in consolidating the experience derived from the numerous de-mining missions by a variety of teams in a variety of countries. Consequently, the James Madison University Mine Action Information Center developed a methodology for collecting, validating, and distributing lessons-learned within the mine action community.

Service Reliability Impacts Of Computer-Aided Dispatching And Automatic Vehicle Location Technology: A Tri-Met Case Study, James G. Strathman, Kenneth Dueker, Thomas J. Kimpel, Rick Gerhart, Ken Turner, Pete Turner, Steve Callas, David Griffin

This paper presents findings on initial changes in service reliability following Tri-Met’s deployment of a new bus dispatching system using automatic vehicle location and automatic passenger counter technology. Changes in on-time performance, headway variation, run time variation, and run times were determined with respect to pre-deployment levels. Changes in headway variation and run times were also used to estimate the initial benefits of the new system with respect to operating costs, passenger waiting, and passenger travel time.

Introduction: This study reports information gathered through a web site evaluation of the 35 municipalities in Onondaga County. The results will be included in a report to each municipality. The report rates municipal web sites. It gives a score (on a scale of 1 to 110) for each site and ideas for the improvement of each site. This Issue Brief, prepared for the Substance Abuse and Mental Health Services Administration, examines the Americans with Disabilities Act ("the ADA") and its application to managed care. The ADA provides important protections for persons with disabilities who are members of managed care arrangements, regardless of whether their membership is sponsored by an employer, Medicare, or Medicaid or is purchased privately. The interaction between the ADA and managed care is complex, and different issues can arise under publicly and privately sponsored plans.

Mineta International Institute for Surface Transportation Policy Studies (IISTPS) at San José State University conducted this study to review the issues and implications involved in the investment of public funds in private freight infrastructure. After thorough legal research, the project team reached the following conclusions: LEGAL ANALYSIS: The California legislature has the legal power to invest public funds in privately-owned freight infrastructure projects State Highway funds, excepting gas tax revenues, may be used for investment in freight infrastructure projects. Among the closely watched demographic trends of the late 20th Century is a pronounced drop in fertility rates throughout much of the world. Italy presents a particularly interesting case for study: in 1960, Italy’s total fertility rate (TFR) was 2.41; by 1995 it had fallen to 1.17. According to United Nations projections, by 2050 Italy will be the second oldest country in the world, with 3.4 persons aged 60 or older for each person under age 15. Summary and Conclusions

A procedure to estimate probabilities of the occurrence of severe convective storms within local areas has been described. Probabilities were based on a simulated climatology and the relative frequency of severe convective events when a selected site was contained within an operational Outlook or Watch. Combined data from five local areas were used to develop a general model for local probabilities within the central and northern Plains region. Attachment of probabilities to specific products placed values within a framework familiar to both forecasters and "end-users." The accident took place in a mined area 30k North West of Beira along the Beira-Mwanza road. The victim was told by the Deputy Platoon Commander to take a hoe and a garden spade to the place marked with four red sticks and dig it out to find the metal that was making the detector signal. The victim started to dig at the place. He was not wearing protective equipment. After digging for ten minutes, at 06:20 the hoe he was using detonated a Type-72a mine [both 72a and 72b are mentioned in the varied papers].

The victim went forward and started to probe the ground. The mine was at an angle in the ground. At 11:45 he probed onto and detonated a mine.

The victim was working in an area of low brush adjacent to a (then) disused farm vehicle track. He was clearing a working lane along a line of PMA-2 mines and his team had found two that morning (one found by the victim). At 11:30 he initiated a PMA-2 by stepping on the mine with his right foot.
