Arbitration clauses in consumer contracts have been subject to controversy in many jurisdictions; recent U.S. and Canadian Supreme Court case law have been used as examples. European Union (E.U.) law, which originally excluded arbitration in general from the Brussels/Rome regimes, has recently taken a mixed, and to some extent limited, approach by including Alternative Dispute Resolution (ADR) entities “imposing” a solution in its recent ADR Directive 2013/11. There seems to be an indirect encouragement to develop consumer arbitration schemes in E.U. Member States as a second route to justice. It is too early to evaluate this new and somewhat clandestine …

The momentum behind development of global online fast track low value high volume dispute resolution (hereafter ODR) continues to accelerate. Consumer and business groups around the world are promoting fair, proportionate, effective, online, fast track redress for low value high volume cross border e-commerce disputes. As a result, there will continue to be increasing demand for a variety of effective ODR systems design and procedural rules. In 2009, the United Nations Food and Agriculture Organization (FAO) adopted the Agreement on Port State Measures to Prevent, Deter and Eliminate Illegal, Unreported and Unregulated (IUU) fishing (PSMA). Countries that ratify the treaty commit to exert greater control at ports over foreign-flagged vessels to detect IUU catch before it is offloaded from vessels, and prevent the ill-gotten catch from entering the world’s markets. The PSMA, when effectively implemented globally, will be a major deterrent to IUU fishing. A major challenge to selecting ports for enhanced controls has been the lack of data on which ports are the world’s largest …

From August 26 to September 8, nine political science students and four supervising faculty traveled from Kennesaw State University to the 2012 Republican National Convention and the Democratic National Convention as part of special topics course on a course titled “Party Conventions Field Study”. While in Tampa and Charlotte, the students and faculty immersed themselves in a “real world” educational environment and in doing so gained extraordinary first-hand exposure to a fundamental, yet not well understood, part of the American political process. Military Cyber Affairs
Cyber operations can be very complex, and it is useful to conceptualize a deeper, fourth technical level of warfare in order to conduct effective planning. The technical details associated with cyberspace operations are not grasped as intuitively by planners and commanders as are the capabilities and limitations of tanks, ships, and aircraft. The complex and dynamic nature of cyberspace often drives technical analysis and planning to a level beyond those planning practices and procedures accommodated by traditional Joint doctrine.

Mediating Teachers As Learners: Conversations From Shared Experience, Paul Watkins

Race to the Top mandates, much like other comprehensive reforms before, focuses on teacher quality and student outcomes. Measuring teacher quality, under Race to the Top reforms, remains a subject of uncertainty, particularly measuring for improvement. This article argues that a central purpose of classroom evaluation is to provide supportive, targeted feedback by differentiating teachers as learners. Drago-Severson and Mezirow offer a framework for adult learning that overlays this theoretical analysis. The three cases explored for this article demonstrate levels of adult learning among teachers, directing the novice to addressing the fully formed transformational learner. Purpose, Scope, and Method of Study: The purpose of this study was to determine if a correlation exists between grade span for ninth grade and gains in math achievement test scores in 10th grade and 12th grade. A quantitative, longitudinal, correlational research design was employed to investigate the research questions. The population was high school students in the United States from public and private schools who were in the ninth grade for the first time during the 1989-1990 school year. Women In Business: Influences On The Undergraduate Major Choices, Victoria Geyfman, Christina M. Force, Laura M. Davis

This study employs a survey of undergraduate business school freshmen to examine factors that influence their decision to study business and whether these factors differ by gender. Specifically, the study examines internal factors, such as students’ perceived aptitudes and interests in the subject; external factors, such as compensation and job availability; and social/interpersonal influences, such as input of teachers, school counselors, parents, and friends. This paper follows up on the authors’ earlier work, which found that despite an increase in the number of male students enrolled in business programs across the nation during the period between 2003 and 2011, female …
