Civil Liberties And The Regulation Of Public Space: The Case Of Sidewalks In Las Vegas, Evelyn Blumenburg, Renia Ehrenfeucht

Conflicts over the nature of and rights associated with public space have a long history and have prompted numerous regulatory responses. Perhaps nowhere in the USA has the regulation of public space been as far-reaching as in Las Vegas, Nevada, where the financial stakes associated with sidewalks are enormous. This study examines how local officials mediate among varied and competing uses of the sidewalk. In defining the function of the sidewalks narrowly, and passively deferring questions of civil liberties, local officials have effectively controlled almost all aspects of public behavior. Is Federalism The Reason For Policy Failure In Hurricane Katrina?, Thomas Birkland, Sarah Waterman

Governmental responses to Hurricane Katrina are generally cited as policy failures. Media and popular analyses focus on the federal government’s policy failures in hazard preparedness, response, and recovery. Meanwhile, disaster experts realize that disaster response is a shared intergovernmental responsibility.We examine the federal nature of natural disaster policy in the US to consider whether federalism, or other factors, had the greatest influence on the failures in Katrina.We find that some policy failures are related to policy design considerations based in federalism, but that the national focus on ‘‘homeland security’’ and the concomitant reduction in attention to natural hazards and disasters, …

Lots Of Luck: Contextualizing Sortition In Approaches To Chance, Mindy Peden

Explores the ways in which luck and chance have been understood by political theorists. Contemporary political thinkers understand luck to describe those situations in which the individual subject has no control. Chance, however, has been understood in a variety of ways over time, beginning with Aristotle suggesting that chance is the “coincidental intersection of two separate causes.” Enlightenment thinkers argue, however, from a more deterministic perspective suggesting that chance is an epistemological category resulting from a deficit of human knowledge. The Making Of The European Energy Market: The Interplay Of Governance And Government, Burkard Eberlein

This case study asks whether delegated, sectoral governance by private actors and arm’s-length agencies enhances policy efficacy or does sectoral governance require a shadow of hierarchy cast by government actors to deliver desired policy results? EU energy market liberalisation shows that sectoral governance successfully mobilises regulatory expertise, capacity and legitimacy and delivers workable norms and rules for market transactions in a complex policy environment. However, it also finds that the efficacy of sectoral governance mechanisms is constrained by distributive conflicts between different national jurisdictions and sector interests. If deadlock occurs, the European Commission as governmental principal casts a double shadow …
