Over the last decade, multiple initiatives have proposed that California should secede from the United States. This article examines the legal aspects of California secession and integrates that analysis with findings from an empirical study of public perceptions of such secession. There is no provision in the United States Constitution allowing states, or other political or geographical units, to secede unilaterally. The Civil War was fought to uphold this principle, and the United States Supreme Court confirmed it in its 1869 Texas v. White decision. "If Consent Is Bought, It Is Not Freely Chosen": Compromised Consent In Prostituted Sex In Ireland, Ivana Bacik
Dignity: A Journal of Analysis of Exploitation and Violence
This article offers feminist arguments for the reconsideration of consent as a legal concept, informed by insights gained through the work of the #MeToo movement and other feminist campaigns. It suggests that consent may be seen as legally compromised in certain contexts of structured gender inequality, such as domestic violence, workplace sexual harassment, and prostitution. The legal understanding of consent in such contexts is antithetical to the conception of consent as “freely and voluntarily” given within a mutual sexual relationship. This understanding of consent underpins the recent introduction of the Nordic model approach into Irish law through the Criminal Law …

This article outlines how nonhuman animals are framed by the emotions of drama, theatre and contemporary performance and considers a distinctive tradition in western culture of enacting animal characters who function as surrogate humans. It argues that, contradictorily, while animal characters confirm anthropocentric emotionalism, drama also contains pro-animal values and concern for animal welfare. Animals embodying emotions in theatrical languages are part of the way animals are used in the traditions of western culture and to think and philosophize with, but they also indicate thinking about the emotions in theatrical performance. Increasingly, the overlap between victims and offenders has received empirical attention with regard to traditional forms of deviance. More recently, the growth of cyber offending has led to a need to examine whether traditional criminological theories can be used to explain these crimes in the same manner as traditional offenses. However, limited attention has been given to victim-offender overlap in cyber-offending. The current study uses a sample of American college students to examine the influence of self-control on cyber offending, cyber victimization, and the cyber victim-offender overlap. Insufficient physical activity is a risk factor for many non-communicable diseases, therefore; the purpose of this study is to examine university students’ perceived exercise benefits and barriers. This cross-sectional descriptive study used Exercise Benefits/Barriers Scale to examine perceived benefits and barriers to exercise among a convenience sample of 517 university students in Jordan. Participants reported significantly higher perceived barriers to exercise than perceived benefits from exercise. The most important perceived barrier to exercise was “I am too embarrassed to exercise”. Moreover, “I will live longer if I exercise” and “exercising increases being accepted by others” were the most important perceived …

This small-scale mixed method study explored perceptions of how different project management approaches and tools are used by those working in industry and within academia, and how this may impact on collaborative research projects given their distinct and unique nature. This Article seeks to examine and compare the judicial behaviors of the five conservative justices on the Supreme Court, especially John Roberts and Neil Gorsuch, through the lens of their social backgrounds and opinion-writing and -joining patterns. Over the past several decades, sentencing reforms have claimed to establish guidelines to reduce sentencing disparity; yet, recent studies continue to find discrepancies in sentencing outcomes. The current study explored individual factors using data from the U.S. Sentencing Commission (FY 2010) to further analyze these variables through the lens of cumulative disadvantage theory. The factors included the influence of age, race, sex (gender), offense type, instant offense score, and overall criminal history score on sentencing length (in months). Originating from the Libyan constitution making process, this paper provides a taxonomy of options for constitution drafters and scholars. In July 2009, the European Central Bank introduced a nonstandard measure to revitalize the European covered bond market, which at the time financed about one-fifth of mortgages in Europe. The market struggled after the collapse of Lehman Brothers as the global financial crisis intensified in 2008. Over the course of the program, which lasted 12 months, European central banks, collectively known as “the Eurosystem,” conducted direct purchases in both primary and secondary markets to a total of €60 billion of covered bonds. For four decades, U.S. Presidents have issued executive orders requiring agencies to conduct comprehensive regulatory impact analysis (RIA) for significant regulations to ensure that regulatory decisions solve social problems in a cost-beneficial manner. Yet experience demonstrates that agency RIAs often fail to live up to the standards enunciated in executive orders and Office of Management and Budget (OMB) guidance. The Office of Information and Regulatory Affairs (OIRA) oversees agency compliance with the executive orders, but OIRA is about half the size it was when it was established in 1980. Prostitution is as old as human civilization itself. Throughout history, public attitudes toward prostituted women have varied greatly. But adverse consequences of the practice—usually imposed by men purchasing sexual services—have continuously been present. Prostituted women have regularly been subject to violence, discrimination, and indifference from their clients, the general public, and even law enforcement and judicial officers.
Jurisdictions can choose to adopt one of three general approaches to prostitution regulation: (1) criminalization; (2) legalization/ decriminalization; or (3) a hybrid approach known as the Nordic Model. Racism is a controversial but present topic in our society. Researchers have identified negative outcomes associated with interactions with racism, microaggression, and racist campus climate. Because universities tend to have racially/ethnically diverse student populations, students might experience racism on campus, which could negatively impact their academic performance.
