This thesis explores the political and demographic obstacles facing the Fairness movement in Kentucky in regards to local employment protection ordinances for LGBTQ+ persons (Fairness Ordinances). Using case studies on recent Fairness debates in Berea and Bowling Green, this thesis explores the concern some Kentuckians have about LGBTQ+ nondiscrimination ordinances in their communities. From these cases studies, it can be concluded that many of the concerns espoused by opponents of Fairness are simple scare tactics with no evidence supporting their claims. The effect of self-control on one’s criminal offending is a product of both an individual’s capacity to exercise self-control as well as their desire to exercise self-control. The present study utilized self-report data gathered at a large urban university in Florida (n=1,307) to test the independent and interactive effects of control-capacity and control-desire on intimate partner violence perpetration. The study suggests that while both capacity and desire for control have effects on one’s likelihood of reporting IPV, these effects are independent of each other.

The public’s perception of individuals who commit sexual offenses is much different than for other types of offenders. This can be seen in the passing of legislation targeting interventions specific to this population as a way to protect the public and reduce recidivism. In some states, sex offenders are required to participate in treatment as a condition for early release from prison. The impact of this policy is not well understood, and mandatory treatment is growing in popularity. Justice exists in and through interpretations of past laws and legal procedures. Justice for sex crimes, however, is particularly complex due to the differences between victim needs and the operations of the criminal justice system. This study, using 70 semi-structured interviews and 2 focus groups from Canadian police departments, shows procedural and distributive justice as the two most prevalent forms of justice police officers use when dealing with sex crimes. Research indicates that the annual incidence of child maltreatment is around 10% and that more than one-quarter of children have, at least indirectly, experienced some form of violence. Prospective studies find that in high-income countries, like the United States, there are moderate correlations between childhood maltreatment and low educational achievement, low skilled employment, depression, suicide attempts, and alcohol problems, as well as strong correlations with obesity, behavior problems in childhood and adolescence, and criminal behavior. Intense demand for cheap labor in the United States has resulted in a widespread effect of employing high skilled immigrants in STEM fields. Examining how companies use high-skilled visa categories to create a flexible cheaper immigrant workforce, this paper demonstrates that skilled immigrants from Asia are being exploited through neutral skills-based criteria that are de facto racially biased. The purpose of this paper is to raise awareness of how, from the perspective of law and society, skills-based immigration works primarily to benefit the technological industry rather than skilled immigrants.

Criminal responsibility (CR; i.e., sanity) has garnered significant research attention over the years. While some variables predicting insanity outcomes are consistent, others are not. Study-level characteristics, such as sample selection, variability in the operational definition of insanity, or other unknown influences may explain discrepant findings. It is critical to consolidate these variables and systematically assess differences in methodology to understand the state of the literature and to guide future research. Martha Nussbaum’s work Political Emotions: Why Love Matters for Justice identifies the role that compassion plays in motivating citizens in a just society. I expand on this discussion by considering how attitudes of indifference pose a challenge to the extension of compassion in our society. If we are indifferent to others who are in situations of need, we are not equipped to experience compassion for them. Building on Nussbaum’s account, I develop an analytic framework for the public emotion of Civic Tenderness to combat indifference.

This paper examines the effectiveness of allocating funds to the nation’s police departments for the prevention of domestic terrorism, as is done annually through the Department of Homeland Security’s Homeland Security Grants Program. The program, administered by the Federal Emergency Management Administration, has distributed billions of dollars since its 2003 inception in equipment, software, and technology services based on the recipient police agencies’ own risk assessments of local terrorism. For touch DNA evidence, there is a clear need for additional individualization, especially for highly probative samples. This could be achieved by testing genetically variable proteins. This study evaluates the predictive validity of a juvenile risk need assessment, the Youth Level of Service/Case Management Inventory 2.0 (YLS/CMI), on a rural population of 215 juvenile offenders using a logistic regression model. The study includes the use of social and demographic variables as control variables, including gender, age, race, special education status, offense type, history of abuse and neglect, and the presence or absence of a police department in the geographic location of crime. The result of the study shows that the YLS/CMI composite risk score significantly predicted recidivism, (x"=19.796, df=1, N=188, p ≤.01). Directions for future research, …

Runaway youth often face a multitude of negative experiences during their childhood, which often leads to trajectories of psychological disorder/distress, victimization, and offending. This propensity for negative life trajectories may be exacerbated by repetitive runaway behavior. Additionally, these negatives experiences may be further shaped by the gender of the youth, thus creating distinct gendered pathways to chronic runaway behavior, victimization, and offending. Adverse childhood experiences (ACEs) and their role as mitigators in capital sentencing is an important, yet relatively unexplored, topic in criminological literature. Using data from the North Carolina Capital Sentencing Project, this study explores the role of ACEs as mitigating factors for youthful and non-youthful capital offenders: whether youthful offenders are less likely to be sentenced to death, whether or not ACEs are effective as mitigating factors, and whether ACE mitigators are more effective for youthful or non-youthful offenders. Researchers have built upon and extended classic theories of inmate behavior to better understand the mechanisms that lead to inmate violence and misbehavior. Yet, scholars still consider what happens to inmates inside of prison a “black box,” due to limited systematic assessments of the prison experience.
