As A Last Resort, Ask The Students: What They Say Makes Someone An Effective Law Teacher, James B. Levy
As A Last Resort, Ask The Students: What They Say Makes Someone An Effective Law Teacher, James B. Levy
Maine Law Review
There is an adage among doctors that “as a last resort, ask the patient.” It is a not so facetious reference to the observation that because doctors are so highly educated and trained, they can start to believe they know what’s best for their patients better than the patients themselves. Consequently, these doctors may discount, or altogether ignore, the opinions of the very people they are suppose to be helping. The same observation could be made about the law professor-student relationship. Unlike doctors, though, our relationship with students is hierarchical, and thus we may be even less inclined to “ask …

More than a decade ago, Katharine Bartlett, currently Dean of Duke Law School, authored a foundational article on discrimination based on appearance choices.1 The article made a big splash, provocatively raising the question of whether discrimination claims based on dress and appearance standards are cognizable under Title VII, the federal law that prohibits discrimination on the basis of, among other aspects of identity, race and sex. [...] to a large extent, their reasoning centered on two ideas: (1) that employers have broad latitude to define the professional boundaries of their workplaces and that grooming standards are a reasonable way for …

Counting Zeros: The Every Student Succeeds Act And The Testing Opt-Out Movement, Paul A. Hoversten
Counting Zeros: The Every Student Succeeds Act And The Testing Opt-Out Movement, Paul A. Hoversten
Michigan Law Review Online
The story begins with threatening letters. In October 2014, the U.S. Department of Education reminded Colorado’s chief state school officer that the department “ha[d], in fact, withheld Title I, Part A administrative funds . . . from a number of States for failure to comply with the assessment requirements” under the Elementary and Secondary Education Act. Given the occasion, the department implied, it wouldn’t hesitate to be ruthless.
Colorado could be forgiven for assuming it was authorized to craft its own policies in this arena; according to the Wall Street Journal, the Every Student Succeeds Act (ESSA) represented “the …

It’S Not Complicated: Containing Criminal Law’S Influence On The Title Ix Process, Margaret B. Drew

Title IX processes that address campus sexual assault are undergoing dramatic changes in structure as well as in review. After receipt of the Department of Education’s 2011 “Dear Colleague” letter, colleges and universities were impelled to review how their institutions were implementing Title IX. From website information through decision making on alleged violations, the ways in which higher education addresses federally guided changes is a matter of national conversation. This essay addresses change in light of campus sexual assault allegations, and does not explicitly address other forms of Title IX complaints, such as athletic funding and opportunities. This essay will …

Emerging Adults: A New Understanding Of Millennial Law Students, Rebecca C. Flanagan
Faculty Publications
The challenges facing emerging adults in law school can be some of the vexing for Academic Success professionals if these students are assumed to have the adult life experiences of prior generations of law students. However, their challenges can be some of the simplest to solve when Academic Success professionals are aware of trends in law school admissions and undergraduate education. Academic Success professionals have the tools to work with doctrinal or substantive professors to provide context to the difficulties students are experiencing with understanding class discussions.
Your Mission, Should You Choose To Accept It: Taking Law School Mission Statements Seriously, Irene Scharf, Vanessa Merton
Your Mission, Should You Choose To Accept It: Taking Law School Mission Statements Seriously, Irene Scharf, Vanessa Merton
Faculty Publications
A law school can best achieve excellence and have the most effective academic program when it possesses a clear mission, a plan to achieve that mission, and the capacity and willingness to measure its success or failure. Absent a defined mission and the identification of attendant student and institutional outcomes, a law school lacks focus and its curriculum becomes a collection of discrete activities without coherence.

Combatting The Core Of Sexual Assault: Training Youth To Become Transformational Leaders In Sexual Assault Perpetration Prevention, Sage Marissa Warner
Combatting The Core Of Sexual Assault: Training Youth To Become Transformational Leaders In Sexual Assault Perpetration Prevention, Sage Marissa Warner
Senior Projects Spring 2017
Sexual assaulters develop from a culture of learned norms, misunderstanding of consent, and inefficacy in bystander intervention. The most significant sexual assault prevention programs teach individuals to dissociate from this culture, by changing their perceptions, knowledge, and behaviors. However, the lack of long-term effects in these programs depicts a vital loophole in their design. In order to change the culture that breeds sexual assaulters, a program cannot focus solely on individuals’ growth, but must ensure a movement of change in the culture itself. Transformational Leadership (Bass, 1985), a style of leadership in which leaders inspire their followers to become leaders, …
