Effective Communication Of Warnings In The Workplace: Avoiding Injuries In Working With Industrial Materials, Victor E. Schwartz, Christopher E. Appel

This Article provides a guide for participants in the supply chain to communicate product risks in the most effective manner to prevent injury where prevention is possible. It suggests how liability rules should be congruent with this same public policy goal. Part II of the Article details the special challenges inherent to effectively warning users of the potential dangers posed by industrial products, while Part III sets forth criteria for meeting these challenges in the workplace. Everybody knows that communication is important, but nobody knows how to define it. The best scholars refer to it. Free-speech law protects it. But no one-no scholar or judge-has successfully captured it. Few have even tried. This is the first article to define communication under the law. In it, I explain why some activities-music, abstract painting, and parading-are considered communicative under the First Amendment, while others-sex, drugs, and subliminal advertising-are not. I argue that the existing theories of communication, which hold that communicative behaviors are expressive or convey ideas, fail to explain what is going on in free-speech cases. Instead, …

From Snail Mail To E-Mail: The Traditional Legal Memorandum In The Twenty-First Century, Kristen Konrad Robbins-Tiscione

Traditional legal memoranda have been used to teach objective analysis since the inception of legal writing programs in the 1970's. The continued use of these memoranda in the legal writing classroom leads law students to believe that traditional memoranda are still the primary form of communication between attorney and client. A 2006 survey of Georgetown University Law Center graduates, however, suggests that the traditional legal memorandum is all but dead in law practice. Seventy-five percent of the graduates surveyed said they write no more than three traditional memoranda per year. Instead, these graduates are more likely to communicate with clients …
