Copyright In Legal Documents, David Vaver

Osgoode Hall Law Journal

Original legal documents and forms have long enjoyed copyright protection. After looking at Commonwealth and U.S. decisions, the author discusses the nature, extent, and desirability of protection. An examination of the technicalities of copyright protection reveals a law drafted in broad generalities and ill-suited to respond adequately to the common practices arising from this class and, by implication, other classes of creative work. The author concludes by suggesting practical ways in which legislators, lawyers, and judges can solve some of the copyright problems generated through the use of legal documents.

Making Immigration Policy Work In The United States, California Latino Legislative Caucus

Nowhere in the United States has immigration become as controversial a political issue as in California. In the 1980s, immigrants accounted for one-third of the nation's population growth, with California absorbing about half of the newcomers. The recent recession has prompted some to blame the State's complex problems - such as unemployment, crime, and the dwindling availability of public resources - on this influx of immigrants. Immigrants are accused of abusing government assistance programs, contributing little or no tax revenue to the public coffers, taking jobs from U.S. citizens and failing to adjust to new communities. It seems appropriate at the onset to set out something of what the disciplines of law, medicine and social work know about family violence and when, during recent years, this knowledge came to the attention of professionals, the public and legislature. We can then, perhaps, judge whether our existing laws, rules of evidence and procedure take this information adequately into account in dealing with cases of violence within the family. Music Copyright In Theory And Practice: An Improved Approach For Determining Substantial Similarity, Stephanie J. Jones

Of the three elements necessary to prove copyright infringement, the substantial similarity standard is particularly difficult to define and implement in the litigation of music copyright actions. This article traces the evolution and finetuning of the Krofft substantial similarity test and exposes the inherent difficulties in the Ninth Circuit's traditional, yet overboard application of the Krofft test by examining the complications it caused in a recent music copyright case, Thompson v Richie. Finally, the article recommends that the Ninth Circuit revise its substantial similarity test by making uniform the application of the substantial similarity test in all music copyright …

The accumulation of radioactive waste is increasingly becoming a world environmental crisis. Radioactive waste poses a special problem to the countries of the European Community. Europe has committed itself to nuclear power and has become one of the world's largest producers of nuclear energy. Moreover, with the 1992 unification of the European Community, nuclear energy output will increase, resulting in a growing production of radioactive waste. Within the European Community, the disposal of radioactive waste is governed by the Euratom Treaty. However, its effectiveness is sharply limited. Individual Member-states retain significant discretion under the Treaty to direct their nuclear energy …

Until recently, Ireland outlawed abortion altogether, subject only to the defense of strict necessity. However, Ireland may now be bringing its abortion policies into line with the more liberal policies of the majority of other European nations, most of which permit abortion. This Article explores the recent changes in Ireland's attitude toward abortion. In particular, this Article examines the interplay of European and domestic Irish forces in the struggle for reproductive rights in Ireland from 1983, the year Ireland adopted a constitutional amendment guaranteeing the right to life of the unborn, to the present.
