Black Holes With Visible Inherent Structure, Milan Meszaros May 1994

Black Holes With Visible Inherent Structure, Milan Meszaros

Milan Meszaros physicist

In the case of Kerr and Schwarzschild black holes there exist continuous standing wave solutions in the total interval (r is greater than 0 and less than infinite) at certain real frequencies. This means that we can see into these black holes at these frequencies with gravitational-wave detectors, studying the radial structure inside the event horizon, too.

Towards The Creation Of An International Legal Regime For The Operation Of Eurocurrency Deposits, Edmund Kwaw Professor

Edmund Kwaw Professor

Eurocurrency deposits and placement transactions give rise to novel issues in international banking. The common law on the banker-customer rules is unable to deal with most of these issues. There is thus the need for an international legal regime to govern such deposit transactions.

A Rose Is A Rose Is A Rose--But Is A Costume A Dress?, Malla Pollack

Malla Pollack

Law differs from life. If a judge, or more importantly a justice, calls a tail a leg, the tail does become a leg. Or, to be precise, the owner of the tail is treated as if he owned a leg. This short essay deals with the changeable meaning of the words "utilitarian function" and "useful article" in the Copyright Act. To be specific, is the Eastern District of New York correct in grouping a Halloween costume with a dress, rather than with a nose mask? This absurd question, timely reraised just after Halloween, is another chimera in the horror house …

Must Boards Go Overboard? An Economic Analysis Of The Effects Of Burgeoning Statutory Liability On The Role Of Directors In Corporate Governance, Ronald J. Daniels Jan 1994

Must Boards Go Overboard? An Economic Analysis Of The Effects Of Burgeoning Statutory Liability On The Role Of Directors In Corporate Governance, Ronald J. Daniels

Ronald J. Daniels

On July 21, 1992, six outside directors on the board of Westar Mining Ltd. resigned abruptly from the company's board of directors. Westar was a troubled mining company operating in British Columbia. In 1991, the company had lost $62.2 million, mainly as the result of a poorly performing export coal mine. While resigning from the board, the directors assured the public that there had been no wrongdoing by the company. Rather, the reason for their departure was related to concern over personal liability for wages and other benefits that might be owed to more than 1900 of the company's employees …

Challenges To The Citadel: A Brief Overview Of Recent Trends In Canadian Corporate Governance, Ronald J. Daniels, Edward J. Waitzer

Ronald J. Daniels

Politicians, bureaucrats, owners, managers and employees are becoming increasingly concerned with the capacity of Canadian corporations to survive and prosper in the twenty-first century. By and large, the attention focused on competitiveness has developed from the rapid international integration of goods, capital and service markets. This integration has resulted in the creation of a new borderless world, in which consumer preferences reign supreme and in which those corporations that fail to anticipate, shape and respond to these preferences with cost- and quality-competitive products face certain failure. Concern over the survival of national firms commands widespread societal attention because of the …

The Paradox Of Corporate Giving: Tax Expenditures, The Nature Of The Corporation, And The Social Construction Of Charity, Nancy J. Knauer Jan 1994

The Paradox Of Corporate Giving: Tax Expenditures, The Nature Of The Corporation, And The Social Construction Of Charity, Nancy J. Knauer

Nancy J. Knauer

Corporate charitable giving is big business. Fundraisers estimate that in 1992, U.S. corporations contributed $6 billion to qualified charitable organizations. Hard-pressed for funds, qualified charities actively seek and compete for corporate contributions. Fundraising literature identifies corporate giving as the last great frontier of philanthropy. Marketing literature touts corporate giving as the latest advertising and public relations technique. Both camps proclaim that corporate giving is good for business and extol the business advantages which flow from transfers to charity. In short, corporate giving means doing best by doing good. Legal scholarship ignores the way corporate giving is described, justified, and expressed …

Problemi Dell'illecito: Superiorità Soggettive E Giudizio Sulla Colpa, Mauro Bussani Jan 1994

Problemi Dell'illecito: Superiorità Soggettive E Giudizio Sulla Colpa, Mauro Bussani

Mauro Bussani

A long-standing tenet of Western negligence law holds that the standard against which the defendant’s behavior should be evaluated is that of a ‘person without qualities’, a fictitious individual allegedly endowed with average knowledge, conventional musculature, ordinary reactions, commonplace skills, and normal intelligence and memory. This paper is based on a comparative analysis of Italian, French, and Anglo-American rules. Its aim is to challenge the ‘person without qualities’ standard, and to demonstrate its empirical, theoretical, and policy flaws when the defendant is a ‘super(wo)man’, that is, someone who, differently from the average (wo)man, is endowed with the physical/intellectual capabilities, the …
