The Investment Chapter In The Regional Comprehensive Economic Partnership: Enhanced Rules Without Enforcement Mechanism, Henry S. Gao

This Chapter examines the legal rules in the investment chapter in the Regional Comprehensive Economic Partnership (RCEP). It starts with an overview and summary of the main provisions in the chapter, followed by an assessment of the rules by comparing established free trade agreements (FTAs), especially the Comprehensive and Progressive Trans-Pacific Partnership. In particular, it notes that the chapter, whilst largely following the established approaches to investment in other FTAs, also includes important twists to the common rules to favour the host states. This is a Union grievance regarding the scheduling of part-time employees and whether temporary student employees should be regarded as part-time for scheduling. The student's total annual work hours could be reduced under the Union's interpretation. Are contract schedule incentives utilized by our acquisition contracting workforce, and if so what are their effectiveness? This research shows there is not widespread use of these types of incentives. There is also disagreement on their perceived effectiveness. Surveying, via email, the population of contracting officers and buyers within Air Force Materiel Command yielded responses from every center and many large acquisition systems. Only 8.5% of responses showed that they use schedule incentives. These respondents claim that schedule incentives are somewhat effective, yet of the 91.5 % that have not used them, 2-to-l say they would not be effective. The …

[Excerpt] “Just like other educational institutions, law schools must schedule courses by taking into consideration student needs, faculty resources, and logistical support such as classroom size and equipment needs. Course scheduling is an administrative function, typically handled by an Assistant Dean or an Associate Dean, who works with the faculty and the registrar to balance these considerations in advance of the registration process. Usually, the entire academic year is scheduled in advance, although the spring semester may be labeled tentative until registration begins for that semester. With ongoing public scrutiny of defense system acquisitions, due to numerous program failures resulting from cost and schedule overruns, now, more than ever, cost and schedule-management competencies are critical to program success. This research examined the schedule-management competencies required of defense program managers. A schedule-management competency model was developed from a foundation of past research. The model was evaluated through a mail survey of 484 intermediate and senior level military program managers assigned to Air Force Materiel Command. The results provided by 243 respondents indicate that 25 of the 28 competencies in the model were valuable to program managers and …

As increasing appellate caseloads strain judicial and support resources available to appellate courts, the incentive for streamlining and expediting the appellate process to accommodate the needs of courts, counsel and litigants also increases. Traditional means for increasing work output, such as addition of judgeships and legal and clerical support staff, are often compromised by general funding problems facing many state jurisdictions, as well as the federal government. As a consequence, alternative means for expediting are sought, including reduction of judicial time involved for review of individual cases, restriction of oral argument and limitations on discretionary review.
