Use Restrictions And The Retention Of Property Interests In Chattels Through Intellectual Property Rights, Thomas Arno

San Diego Law Review

Granting intellectual property rights promotes invention but also encourages wasteful expenditures to avoid monopoly prices. If patent or copyright owners are allowed to place some types of restrictions on the products they sell, these wasteful efforts can be avoided. This Comment discusses restrictions that have this effect and how intellectual property law might best create a doctrine enforcing them.

This Symposium on Television and Violence was developed as the first in a series to be offered under the auspices of the Joseph Kushner Distinguished Professorship in Civil Liberties Law, held by Professor Leon Friedman. We have gathered today to discuss television and violence because it is a topic of current interest, a new concern. Some of us are old enough to remember similar distress expressed in the 1950s, primarily by private persons rather than the government, over violence in comic books. Judges, Behavioral Scientists, and the Demands of Humanity grapples with one of the most pressing and difficult challenges of our time – how to overcome deep and enduring conflicts that currently divide our community. New Technology And Old Protection: The Case For Resale Royalties On The Retail Sale Used Cds, Carla M. Miller

The development and introduction of audio compact disc technology into the consumer market has been an enormous commercial success. Due to its relatively low production cost, convenient packaging, and near indestructibility, the compact disc has virtually rendered traditional recording media obsolete. In mid-1993 several music retailers announced their intent to capitalize on the most attractive characteristic of the compact disc-its durability-by actively promoting a resale market for used CDs. The retailers' practice of selling used CDs is protected by the "first sale" doctrine of federal copyright law and currently represents a windfall for them since resold goods fall outside copyright …
