Section I of this Note discusses the case’s procedural history. Section II discusses the Cassirer family story and looks at the history of America’s legislative efforts aimed at impacting Holocaust-era art restitution litigation since the end of WWII. Section III discusses the Ninth Circuit’s application of HEAR and compares it to subsequent interpretations of the Act. Lastly, section IV discusses changes that Congress could make to HEAR that would help ensure that the Act has the impact that the legislature intended.

Little attention is paid to the far reaches of the federal judicial system, which extends beyond the boundaries of the continental United States and even beyond the outermost states of Alaska and Hawaii; Puerto Rico is part of the First Circuit,1 and the Virgin Islands are part of the Third Circuit.2 Most particularly, the Ninth Circuit encompasses not only Hawai’i but also the territories of Guam and the Northern Mariana Islands (NMI). The first section of this Article discusses the judge as an author. This section begins with an examination of the audience for judicial opinions and an outline of the different styles of judicial opinion writing. The second section of this Article examines the advantages and disadvantages of using literary tools to advance the law. The third section of this Article explores the role of the author as a judge.
