Legal Reform In Contemporary Japan, Eric Feldman

In this chapter I offer a preliminary assessment of a quickly moving target—legal reform and its impact on rights in Japan. Although a broad consensus has emerged among interested parties that at least some degree of reform is desirable, there is significant disagreement about the goals of reform, and also about the likelihood that it will achieve certain objectives. Some commentators believe that the Japanese legal system is on the cusp of a “revolution” that will shore up long-neglected rights and create new entitlements. Others predict that the consequences of reform will be modest; and they despair that aggrieved individuals …

Reiterated Commemoration: Hiroshima As National Trauma, Hiro Saito

This article examines historical transformations of Japanese collective memory of the atomic bombing of Hiroshima by utilizing a theoretical framework that combines a model of reiterated problem solving and a theory of cultural trauma. I illustrate how the event of the nuclear fallout in March 1954 allowed actors to consolidate previously fragmented commemorative practices into a master frame to define the postwar Japanese identity in terms of transnational commemoration of "Hiroshima." I also show that nationalization of trauma of "Hiroshima" involved a shift from pity to sympathy in structures of feeling about the event. This historical study suggests that a …

Singapore’s transborder industrialization projects in China and India have received much attention. This regionalization initiative was intended to set in place a strategic configuration for the city-state to restructure its domestic industries and, pari passu, retain important linkages with contiguous, low-cost environments. Our study reports on Singapore’s pioneering, albeit lesser-known, project - Batamindo Industrial Park – in neighboring Batam Island, Indonesia, and finds that the strategic intent of this policy gambit remains stymied by non-economic, socio-political complexities in the host environment, and the economics of competition from other industrial estates in the vicinity of this prototype, remains to be addressed.

This paper revisits Singapore’s industrial development in Suzhou, China, which has been in operation for more than a decade. We aim to glean insights from this experiment and more importantly, to verify recent claims of it generating political gain and economic capital for Singapore. The flagship project took on an identical framework as the other Singaporean transborder industrialization ventures in the region by adopting Singapore’s expertise and reputation for an efficient and stable government and investment environment. Widely regarded as an anomaly in the neo-authoritarian system in Malaysia, Malaysiakini.com is proving that managing an independent media in a government-managed media landscape is more than a Sisyphean struggle. Employing participant observation and interviews, supplemented by artifacts and media accounts, this study seeks to understand the media management of Malaysiakini.com through news management, using Shoemaker and Reese’s (1996) hierarchy of influence model, which posits a framework of internal and external forces that affect news management. The State‐Led Transition To Liberal Capitalism: Neoliberal, Organizational, World‐Systems, And Social Structural Explanations Of Poland’S Economic Success, Lawrence P. King, Aleksandra Sznajder Lee

Neoliberals argue that rapid liberalization and privatization can transform postcommunist economies into Western-style capitalist systems. Organizational sociologists argue that these policies produce a unique variety of capitalism, while world-systems theorists argue that they lead to underdevelopment. This article advances a social structural alternative in a crucial case. Poland’s relative economic success resulted from prolonged state ownership and an interventionist state employing various industrial policy tools that facilitated efficiency-enhancing market-oriented restructuring before ushering in beneficial foreign direct investment. The resulting capitalist system closely resembles the typical pattern found in most late industrializers.

Since the World Trade Organization (WTO) was established, China his made large-scale efforts to shape its trade remedy system through legal and organizational changes. Through these changes, China could clarify the meanings of WTO anti-dumping provisions including the provision relating to the definition of domestic industry. The field of archaeology incorporates a confusing assortment of ideas and approaches to the record. With studies ranging widely in ideology and goals, from strict descriptive materialism to sociological interpretation, language used to communicate key concepts (not to mention which concepts are key) also varies widely, resulting in low levels of mutual interest and intelligibility across the discipline. Archaeologists commonly ignore the majority of available literature as a result, further widening intellectual chasms.

The purpose of this paper is to provide quantitative fire history information for a geographically unique region, the Loess Hills of northwest Missouri. We sampled 33 bur oak (Quercus macrocarpa Michx.), chinkapin oak (Q. muehlenbergii Engelm.), and black oak (Q. velutina Lam.) trees from the Brickyard Hill Conservation Area in northwest Missouri. The period of tree-ring record ranged in calendar years from 1671 to 2004 and fire-scar dates (n = 97) ranged from 1672 to 1980. Fire intervals for individual trees ranged from 1 to 87 years. Gizzard shad are a riverine species commonly transplanted into man-made reservoir systems to provide prey for predatory game fish. Thermally limited, the range of their native distribution extends into the midwestern Great Plains. Following the harsh winter conditions of 2000-2001, numerous incidents of extensive gizzard shad die-offs were reported in eastern Nebraska during spring ice-out. In an effort to determine the breadth and extent of mortality, statewide fish population surveys conducted between 1994 and 2004 were examined, and it was found that gizzard shad were extirpated from seven flood-control reservoirs in a localized area of eastern Nebraska. Are Anti-Spit Tobacco Campaigns Striking Out? A Survey Of Iowa And Nebraska College Baseball Players, David C. Ogden, Teresa A. Lamsam, Hugh J. Reilly, Michael L. Hilt

Anti-spit tobacco information is replete with fear appeals, including firsthand accounts of death and debilitation, to make users aware of the health risks and dangers. Those dangers, however, are well known by baseball players whose association with spit tobacco is historic. A survey of 217 Iowa and Nebraska college players showed that despite their awareness of spit tobacco's dangers, the players use spit tobacco to relax and focus on the field. This study supports other research showing that fear appeals may not be the most appropriate approach for anti-tobacco advertising campaigns. Wetland restoration typically includes modifications to soils, flora, and hydrology. Will the return of wetland hydrology to former saline wetlands create conditions suitable for wetland taxa, especially saline wetland indicator species? To answer this question we evaluated the potential restoration efficacy of historical saline wetland soils by re-exposing them to wetland hydrological conditions simulated in a greenhouse. Agricultural lands contained no saline indicator plants and limited wetland species, likely due to significant and long-term land alteration. Restored wetlands showed only a few additional wetland taxa, and seeds of saline wetland plants emerged from soils of only one restored site. Because …

In the next decades, aging farmers in the United States will make decisions that affect almost 1 billion acres of land. The future of this land will become more uncertain as farm transfer becomes more difficult, potentially changing the structure of agriculture through farm consolidation, changes in farm ownership and management, or taking land out of production. The Great Plains Population and Environment Project interviewed farmers and their spouses between 1997 and 1999. Farm Family Survey participants were ambiguous about their plans to leave farming, transfer land to others, and even long-term land use, largely due to concerns about the …

We studied relations between river size, fish species diversity, and fish species composition along four major rivers in the Great Plains of southwestern South Dakota to assess patterns of species diversity and composition. We expected diversity to increase with river size and fish composition to change via species addition downstream. Previous surveys of 52 sampling stations provided fish assemblage data, and we used the Geographic Information System (GIS) to determine watershed area by station. Watershed area did not predict species richness or species diversity (Fisher's a), so species richness of 12 ± 3.5 SD species and Fisher's a of 2.3 …

Fire History At The Southwestern Great Plains Margin, Capulin Volcano National Monument, Richard P. Guyette, Michael C. Stambaugh, Rose-Marie Muzika, Erin R. Mcmurry

Great Plains Research: A Journal of Natural and Social Sciences

This study documents historic fire events at Capulin Volcano National Monument over the last four centuries using dendrochronologically dated fire scars at two sites: the lower volcano lava flows (the Boca) and the adjacent canyon slopes (Morrow Ranch). The mean fire interval (MFI) was 12 years at the Boca site (before 1890) and 5.4 years (1600-1750) and 19.1 years (1751-1890) at the Morrow Ranch site. Data from the Boca and Morrow Ranch sites combined with the extremely pyrogenic landscape position of the volcano slopes indicate that the volcano slopes likely burned more frequently (e.g., MFI <5 yr). Around 1750, the fire regime appeared to transition to longer fire intervals, greater temporal synchrony among fire-scarred trees, and a higher proportion of trees scarred in fire years. Temporal variability in the fire regime at Capulin Volcano may reflect changes in human populations, climate, and land use.

The highest concentrations of arsenic in groundwater are found in the Nebraska Panhandle, southwestern Nebraska, and the Republican River valley. Data from 33 public water supply wells indicate that significant variability in arsenic concentrations did not occur over a one-year study. The general absence of temporal variability in arsenic concentrations suggests that the collection of one sample per year from most wells will adequately characterize the arsenic concentrations to which the population drinking this water will be exposed. The collection of additional samples is strongly recommended if the reported arsenic concentrations are at, or slightly above, 10 μg/L in order …

Social and cultural geographies have long occupied a marginal position in Taiwan's scholarship in the humanities and social sciences. Despite the influence of the so-called ‘cultural turn’ that has characterized much of Anglo-American scholarship since the 1990s (Barnett 1998), Taiwan's scholarship in the social sciences in general and human geography more specifically has remained relatively untouched by these intellectual currents till very recent years. This paper seeks to examine the social, intellectual and institutional contexts that explain this marginalization, and consider the possibilities for social and cultural geographies' emergence from marginality in Taiwan in the future. There is no single approach to government procurement regulation among Asian countries. While some are signatories to the WTO's Government Procurement Agreement (GPA), others are not. Some have deliberate policies which confer preferences on domestic suppliers of goods and services. Even so, some have embarked on changing their GP regimes independently of WTO requirements. Yet others appear to be prepared to make changes in tandem with the negotiation of bilateral or regional free trade agreements. This article examines government procurement from these varied perspectives of Asian countries.

In this article, I explore the sociality of cultural industries by analyzing the film industry in Hong Kong. In particular, the social networks and relationships at multiple scales – across national boundaries, within local settings and on production sets – are examined, revealing their critical role in contributing to the health of the film industry. The risks faced at various steps of the production, marketing and distribution process are ameliorated by trust relations, built up through time between social actors in spontaneous ways. Recent dialogues in geography and the social sciences have reminded researchers of the extent to which academic and policy knowledges are socially and spatially embedded-that is, they circulate through formal and informal systems of publishing, exchange, commodification and cultural influence. Academic and policy knowledges are, in short, very much a part of the creative economy. In light of this, our paper surveys knowledges of the creative economy itself, as reflected in a geography of industry reports and government policy statements in selected Asian countries. Emboldened by the ascendance of economic issues on the global agenda and the erosion of security-driven bipolar structures, Taiwan in the late 1980s decided to use its economic advantages for diplomatic gain. Examination of changes in three phases of Taiwan's initiatives indicates that its inter-governmental organization strategies and targets correlate well with domestic politics and external factors.
