“Genocide Of The Soviet People”: Putin’S Russia Waging Lawfare By Means Of History, 2018–2023, Anton Weiss-Wendt
Genocide Studies and Prevention: An International Journal
This article exposes the political underpinnings of the term “genocide of the Soviet people,” introduced and actively promoted in Russia since 2019. By reclassifying mass crimes committed by the Nazis and their accomplices against the civilian population—specifically Slavic—as genocide, Russian courts effectively engage in adjudication of the history of the Second World War. In the process, genocide trials, ongoing in twenty-five Russian provinces and five occupied Ukrainian territories, present no new evidence or issue new indictments, thus fulfilling none of the objectives of a standard criminal investigation. The King And His Favorites: A Historiographical Analysis Of Edward Ii, Luke Ziegler

The historiography of Edward II has painted him as a weak king who deserved deposition, overemphasizing his faults while under-examining the circumstances in which he had to rule. Starting from the earliest chronicles, through the early modern period, 19th and 20th centuries, and through the present, the historiography demonstrated the changes that Edward II’s reputation has undergone. These changes went from thinking of Edward as a weak king who should be blamed for all of England’s ills, to acknowledging and addressing his faults while realizing that not everything was under Edward’s control to fix.

Behind Bars: An Analysis Of The Incarceration Of Black Americans, Tommy A. Valente

In this study, I attempt to explain the disproportionate incarceration rates which exist in the United States. The black American are incarcerated at a significantly higher rate than any other ethnic group in the country. I hypothesize single parent households and poor public education systems will have significant influences on incarceration rates. For this study I run an OLS regression and use data from all fifty states between 2019-2020. I use seven independent variables in this study: ACGR score, GDP per capita, unemployment rate, percent of births to unmarried women, homicide rate, population, and political party affiliation of a state. …

This Article delves into the life and work of Judge [Florence] Allen to provide insight to the contributions and jurisprudence of the first woman judge. For history questions what difference putting a woman on the bench might have made. Part I explores Allen’s early influences on her intellectual development grounded in her progressive and politically active family, and her close network of female professional friends. Part II discusses her pivotal work with the women’s suffrage movement, working with the national organizations in New York and leading the legal and political efforts in Ohio. Blackstone, Expositor And Censor Of Law Both Made And Found, Jessie Allen

Jeremy Bentham famously insisted on the separation of law as it is and law as it should be, and criticized his contemporary William Blackstone for mixing up the two. According to Bentham, Blackstone costumes judicial invention as discovery, obscuring the way judges make new law while pretending to uncover preexisting legal meaning. Bentham’s critique of judicial phoniness persists to this day in claims that judges are “politicians in robes” who pick the outcome they desire and rationalize it with doctrinal sophistry. Such skeptical attacks are usually met with attempts to defend doctrinal interpretation as a partial or occasional limit on …

In response to Beatty’s inquiry, the former Kentucky governor writes that, despite facing personal financial loss, he is unable to advise on current debt relief measures directing Beatty to accept payments to “the Bank,” presumably the Bank of Kentucky, in discounted notes of the Bank of the Commonwealth.

Land And Law In The Age Of Enterprise: A Legal History Of Railroad Land Grants In The Pacific Northwest, 1864-1916, Sean M. Kammer
Department of History: Dissertations, Theses, and Student Research
Federal land subsidies to railroad corporations comprised an important part of the federal government’s policies towards its western land domain in the middle decades of the nineteenth century. In all, Congress granted over a hundred million acres to railroad corporations to subsidize construction of a transcontinental railway network. Long after the last such grant in 1871, these land grants continued to incite political contests in Congress and state legislatures and legal disputes in communities across the West. By the end of the century, railroad corporations had become manifestations not just of the threatening growth of corporate power in the United …
