This thesis examines the obstacles that make environmental protection challenging to litigate, particularly in the context of climate change, and identifies the underlying reasons for these obstacles. I emphasize the significance of preserving nature and provide a historical overview of environmental conservation. Despite the pressing nature of climate change and environmental degradation, legal efforts to combat these issues have often yielded unsatisfying results due to a lack of transparency, accountability, and fair power dynamics. In the mid to late 20th-century, climate change and other environmental issues were addressed on a bipartisan basis, with Republican politicians like President Richard Nixon and George H.W. Bush supporting and advancing measures to combat climate change. However, since the 1990s, climate change has become increasingly polarized, with significant polarization in the last decade. This paper dives into the causes behind climate change's politicization and polarization and what the future holds for bipartisan agreement by analyzing peer-reviewed articles, campaign contributions, news stories, political archives, and past interviews with climate experts. Environmental Impact Assessment (EIA) is a tool mandated by regulatory authorities to prevent environmental degradation and foster a sustainable environment. Procedural rights to access information and participate in decision-making are understood as key components of good environmental governance. This research compares the EIA laws in Nigeria and Canada and identifies areas of improvement in the EIA processes of both countries with regards to oil and gas activities, in light of existing international norms and, with a focus on public participation and climate change.

While the majority of Chile’s intact watersheds are located in the largely uninhabited southern Patagonia regions of the country, the majority of the Chilean population lives in the nation’s parched central regions. In the face of recent trends in climatic change, including dramatic decreases in snowpack, diminishing glaciers, and shifts in precipitation cycles and seasons, mountain contributions to local watersheds are predicted to continue dwindling as aridification worsens around the world and throughout Chile. This thesis shows how an emissions trading scheme can help African countries contribute to the goal of stabilizing the concentration of greenhouse gases in the atmosphere. This is done through an assessment of the gaps in Africa’s climate change mitigation policy architecture and the potential benefits of emissions trading as a policy instrument—including lessons learned from emissions trading schemes implemented in the US, the EU, New Zealand, and Chile. The thesis concludes that adopting an emissions trading scheme as a policy instrument in Africa could potentially close the gaps in its policy architecture.
