In Federal Trade Commission v. Actavis, Inc., the Supreme Court provided fundamental guidance about how courts should handle antitrust challenges to reverse payment patent settlements. The Court came down strongly in favor of an antitrust solution to the problem, concluding that “an antitrust action is likely to prove more feasible administratively than the Eleventh Circuit believed.” At the same time, Justice Breyer’s majority opinion acknowledged that the Court did not answer every relevant question. The opinion closed by “leav[ing] to the lower courts the structuring of the present rule-of-reason antitrust litigation.”This article is an effort to help courts and counsel …

The Supreme Court’s opinion in Federal Trade Commission v. Actavis, Inc. provided fundamental guidance about how courts should handle antitrust challenges to reverse payment patent settlements. In our previous article, Activating Actavis, we identified and operationalized the essential features of the Court’s analysis. Our analysis has been challenged by four economists, who argue that our approach might condemn procompetitive settlements.As we explain in this reply, such settlements are feasible, however, only under special circumstances. Moreover, even where feasible, the parties would not actually choose such a settlement in equilibrium. These considerations, and others discussed in the reply, serve to confirm …

Entrepreneurship and innovation play a key role in combating problems facing agribusinesses, including the need for water conservation, sustainable packaging, and environmental protection. These issues have led to an increasing demand for college graduates with technical skills and innovative ways of thinking. The objective of our research is to provide insight into character traits that signal entrepreneurial skills. We conducted a survey to examine entrepreneurial interests and perspectives among U.S. agribusiness students. A cluster analysis revealed that entrepreneurial-minded students were more likely to be male, consider themselves risk takers, and have parents directly engaged in production agriculture. This study explores the current state of innovation and high-tech entrepreneurial initiatives in Historically Black Colleges and Universities (HBCUs). Previous research showed that institutions’ environment, faculty empowerment, organizational trust, early stage capital, innovation centers and innovative teaching practice had a major effect to support innovation and foster tech-entrepreneurship. We present our conceptual model. The final section explains the current state of research and implications for future research are discussed.

This study fills a gap in the entrepreneurship literature by investigating creative achievement and intelligence within students who have been entrepreneurs. The study looks at differences in the levels of creative achievement and intelligence between students who have been entrepreneurs versus those who have not been entrepreneurs. The study used the Creative Achievement Quotient (CAQ) (Carson, Peterson, & Higgins, 2005) and college entrance exam scores and grades as measures of intelligence. There were several significant findings. First, students who had been entrepreneurs had significantly lower college entrance exam scores. Higher education is facing several obstacles, one of which is the prolific rise in Massive Open Online Courses (MOOCs). This article examines the history of online education and also provides a background of the current organizations that are competing in the MOOC industry. The success of MOOCs and the current hurdles they have to overcome are examined. The article also discusses the current and future potential impact of MOOCs on higher education. Prior Knowledge And New Product And Service Introductions By Entrepreneurial Firms: The Mediating Role Of Technological Innovation., Patrick Murphy, Jintong Tang

Most research on new product and service development by entrepreneurial firms takes an individual-level, pre-launch perspective or firm-level post-launch perspective. Our study examines two components of the new product and service introduction process: how entrepreneurs’ prior knowledge underpins (1) firm technological innovation prior to the introduction of new products and services (pre-launch) and (2) post-launch viability of those new products and services. Our findings, based on a series of analyses of data from 158 entrepreneurial firms, show that formal technological innovation fully mediates the relation between prior knowledge and the introduction of viable new products and services.

This paper describes a study that investigates the mediating effects of information technology (IT) on the relationships among product and process innovations and firm performance (measured in multiple profitability and growth rate metrics). Using structural equation modeling on a sample of 397 small and medium-sized enterprises (SMEs), we find evidence that (1) increases on the strategic emphasis placed on innovation, both product and process, positively impact the prominence managers place on IT; (2) the impact of innovation (both product and process) on performance (both profitability and growth) is primarily indirect, felt via the mechanism of the importance managers place on …

This paper investigates the applicability of contemporary firm-level innovation concepts to a developing country context by drawing on the results of a survey of Malaysian manufacturing and service establishments. We build on Keith Pavitt’s ‘technology trajectories’ framework to empirically test the effect of firms’ structure, strategy, resources, and environment on the probability of their product, process, and organisational innovations across various sectors. We find that Malaysian firms possess relatively high process and organisational innovation capabilities, but lag in new product development. Further, they more frequently utilise a variety of ‘soft factors’ like employee training, knowledge management practices, and collaboration with market actors …
