The Application Of The Criminal Law Of A Country To Acts Committed By Foreigners Outside The Jurisdiction, Walter Wheeler Cook
West Virginia Law Review
The present paper is confined to a discussion from an American point of view of the application of the criminal law of a country to acts committed by foreigners outside the territorial limits of the country concerned. It will include a statement of the prevailing theories adopted by American courts and jurists, accompanied by a brief summary of typical cases decided by American Courts, and a critical analysis of these theories and of their application in American judicial opinions.

In April of this year a Minnesota physician, Dr. Clayton E. May, treated for gunshot wounds a certain undesirable person, John Dillinger, very much in demand by the police. He further neglected to inform the police concerning his ministrations, and as a result, was tried in a federal court on a charge of harboring a fugitive wanted under a federal warrant, found guilty, and sentenced to serve two years in a penitentiary and to pay a fine of $1,000.
