Houve tempo em que a Constituição servia para poisar ou charuto ou tirar um argumento político, como ironicamente afirmaria o grande escritor oitocentista Eça de Queiroz. Hoje a Constituição é a norma das normas. Daí há consequências hermenêuticas. Ao contrário das teorias que importam interpretação tradicional e, por vezes, em grande medida ultrapassada, para o Direito Constitucional, a tendência actual é a inversa: dada a supremacia da Constituição, deve ser a metodologia constitucional a exportar hermenêutica para o todo do Direito. Para isso, começamos neste artigo com grandes princípios de hermenêutica intra-constitucional. Depois se passará à exportação.

En el presente artículo se plantean las diferencias entre los mecanismos contractuales cuyos efectos se encuentran vínculados al evento muerte de un invididuo. Con ello se intenta evidenciar, por un lado, que no todo contrato mortis causa es un pacto sucesorio y, por otro lado, que algunos de ellos se erigen como alternativas al testamento. Todo ello importará una reconfiguración de ciertas categorías negociales consideradas institucionales.

La importación de modelos jurídicos estadounidenses al ordenamiento peruano, afín por tradición a la familia del derecho civil, se viene consolidando, indolentemente y casi siempre de la mano con la dependencia económica, no sólo en particulares áreas del derecho (civil, comercial, bursátil, minero, ambiental, etc.), sino en la propia enseñanza universitaria y, no menos mecánicamente, en los proyectos de códigos de ética profesional para abogados. Urge, más que nunca, una comparación jurídica crítica que subraye y prevenga de los riesgos de la globalización del derecho para los países subdesarrollados.

Federal procedure has embraced the referral of civil cases outside the court system to alternative dispute resolution. This article argues that by utilizing courts to settle cases through civil procedure, courts realize their central role in ensuring the quality of settlements produced through the judicial administration of justice. Compared with other World Trade Organization (WTO) Agreements, the Technical Barriers to Trade (TBT) Agreement has received relatively little scholarly attention. This paper will illustrate that the TBT agreement has already exhibited potential to penetrate inappropriately into the domestic regulatory order and threaten domestic regulatory autonomy in unexpected ways, even if many important provisions are still to be elucidated in follow-up dispute settlement practice. This unwarranted intrusion into domestic regulatory autonomy is largely due to the reluctance of WTO panels and the AB to explore the telos of the TBT Agreement. De un tiempo a esta parte, los tribunales civiles de Lima vienen concediendo resarcimientos a ciegas, sobre la base del artículo 345-A del Código Civil peruano, en el cual se obliga al magistrado, a "velar por la estabilidad del cónyuge perjudicado" en los casos de separación de hecho, ya señalando una "indemnización", ya ordenando la "adjudicación preferente de bienes de la sociedad conyugal".

En este comentario de jurisprudencia se explica por qué es equivocado asociar la "indemnización" referida en dicha norma con la responsabilidad civil, y se brindan elementos para su correcto enfoque como importante manifestación de la solidaridad familiar.

The article addresses a current WTO dispute between the United States and the European Communities on selected customs matters. The article discusses the necessity for a uniform WTO agreement on trade facilitation, as well as analyzes the apparent inconsistency between the General Agreement on Tariffs and Trade (GATT) Article X’s mandate for WTO Members to uniformly, impartially, and reasonably administer municipal customs laws and Article XXIV’s allowance of individual members of a customs union to substantially apply common commercial regulations and laws in relation to non-members of the customs union. 中国的股权分置改革一方面要使非流通股股东取得流通权,另一方面也要让流通股股东获得合理补偿以求改革能够稳定推进. 传统观点下的契约理论和行政征收理论并不能适切解释中国的股权分置改革方案. 在公,私法融合背景下,美国学者新近提出的行政授予 (regulatory givings)学说,可与大陆法上的行政行为附款理论相互协力,为改革方案提供正当性基础。改革中采用财产法则而非补偿法则保障流通股股东的权益,实属符合经济效率之举. 然而,本方案仍有诸多值得改进之处.

Argentina, like much of Latin America, has historically been plagued by what some call delegative democracy or a democracy without any developed rule of law. However, the Kirchner Administration has brought a glimmer of hope to the twentieth-first-century Argentine democracy. President Néstor Kirchner was elected in 2003, after what was probably the most serious institutional, financial, and economic crisis in Argentina in recent times. When elected, Kirchner promised to address the perceived lack of independence of the Supreme Court and to restore the rule of law. 行政裁量权在普通法的行政法中占有举足轻重的地位,与此相比,裁量权在法国行政法中并没有受到同等规格的待遇。裁量权在普通法的行政法学著作中常以专章出现,而在法国行政法的教材中,它往往分散于论述合法性原则的各个章节之中,较少被集中研究。个中原因,大约可举出两点。一是,在名称上,它留有旧制度的痕迹——在十九世纪最高行政法院的判例中,“‘裁量行为(actes discrétionnaires)’指的是不受任何诉讼质疑的行政行为” 。在很多时候,“裁量权”意味着强大的行政权力。尽管20世纪以来的行政法院判例已发展出数种技术,在较大程度上将裁量权置于司法审查之下,但是,裁量权总是含有一种不让法学家和律师信任的意味。二是,在法国行政法学者的眼里,普通法、尤其是英国普通法下的行政法,偏重对行政行为的审查,可看作一个审查体系(système de contrôle),相比之下,法国行政法的外延更为广阔,是一个规则体系(système de règle),它以合法性原则(principe de légalité,也被称为行政法治原则 )为核心,涵盖了行政组织、行政行为等各个方面的多种类、多层次的规范,这些规范按照各自所属的渊源位阶高低,组合成一个宏大而精密的凯尔森式的规则体系 。因此,对裁量权的认识,应该在合法性原则的框架内进行。

一方面,法学家承认裁量权的重要性,认为合法性原则没有排斥行政机关拥有决定的自由——裁量权,而且,从这个角度看,裁量权构成了对合法性原则的限制。另一方面,法学家强调裁量权不等于“任意裁断”,倾向于将它置于合法性原则的影响之下,坚持裁量权只不过是“在(至少)两种合乎合法性原则的决定或行为之间选择的权力”,自由裁量永远只是在法律允许范围内的自由裁量。

在这种颇有点相互矛盾的心态的推动下,不仅法学理论尝试调和行政自主和法治要求之间的张力,行政法官也坚持不懈地创造出新的审查技术,尤其是“明显错误”审查、“损益表” 比例审查等,因应社会需求的变化对不断膨胀的行政裁量施加判例法上的约束,又力图避免一刀切式的羁束。下文将首先介绍法国行政法学对裁量权概念、性质和意义的看法,其后再结合判例考察在裁量权在司法实践中受到的控制。

The increasing use of comparative jurisprudence in interpreting constitutions is one example of this.
