In FTC v. Actavis, Inc., the Supreme Court considered "reverse payment" settlements of patent infringement litigation. In such a settlement, a patentee pays the alleged infringer to settle, and the alleged infringer agrees not to enter the market for a period of time. The Court held that a reverse payment settlement violates antitrust law if the patentee is paying to avoid competition. The core insight of Actavis is the Actavis Inference: a large and otherwise unexplained payment, combined with delayed entry, supports a reasonable inference of harm to consumers from lessened competition.This paper is an effort to assist courts and …

In Federal Trade Commission v. Actavis, Inc., the Supreme Court provided fundamental guidance about how courts should handle antitrust challenges to reverse payment patent settlements. The Court came down strongly in favor of an antitrust solution to the problem, concluding that “an antitrust action is likely to prove more feasible administratively than the Eleventh Circuit believed.” At the same time, Justice Breyer’s majority opinion acknowledged that the Court did not answer every relevant question. The opinion closed by “leav[ing] to the lower courts the structuring of the present rule-of-reason antitrust litigation.”This article is an effort to help courts and counsel …

The Supreme Court’s opinion in Federal Trade Commission v. Actavis, Inc. provided fundamental guidance about how courts should handle antitrust challenges to reverse payment patent settlements. In our previous article, Activating Actavis, we identified and operationalized the essential features of the Court’s analysis. Our analysis has been challenged by four economists, who argue that our approach might condemn procompetitive settlements.As we explain in this reply, such settlements are feasible, however, only under special circumstances. Moreover, even where feasible, the parties would not actually choose such a settlement in equilibrium. These considerations, and others discussed in the reply, serve to confirm …

A review of the innovation literature reveals theoretical models and success factors that pertain to the front end of innovation. However these models and factors fail to offer insight into factors large organizations consider when specifically performing the activity of idea selection. To bridge this gap, a grounded theory method was used to extract knowledge on innovation idea selection from 28 senior executives and innovation directors from 10 different, large organizations (defined as annual revenues greater than $1 billion). As continuous innovation became a strategic necessity in many markets, organizations are increasingly adding external resources to complement their in-house R&D activities. However, little is known about the concrete practices of employing and integrating those external resources. Hence, this research introduces a new conceptual framework of supply chain resource orchestration (SCRO) on the basis of a systematic literature review and a theory elaboration of resource management theories. Qualitative interviews with supply chain managers in a multi-case study are enriching and substantiating the SCRO conceptualization. The study aims to explore why some societies are more innovative than others in high-technology sectors. Following a crossvergence perspective, we generate nine causal conditions by accommodating both cultural and institutional varieties: uncertainty avoidance, masculinity, individualism and power distance as culture indicators, and union density, skill development, market capitalization to credit, prevalence of cluster and state dominance as institutional indicators. Applying the configurational approach, we conducted fuzzy-set qualitative comparative analysis (fsQCA) on Organization for Economic Co-operation and Development (OECD) member countries. Online crowdfunding is a popular new tool for raising capital to commercialize product innovation. Product innovation must be both novel and useful (1-4). Therefore, we study the role of novelty and usefulness claims on Kickstarter. Startlingly, we find that a single claim of novelty increases project funding by about 200%, a single claim of usefulness increases project funding by about 1200%, and the co-occurrence of novelty andusefulness claims lowers funding by about 26%. Our findings are encouraging because they suggest the crowd strongly supports novelty and usefulness. However, our findings are disappointing because the premise of crowdfunding is to support …

We examine the effect of unionization on firm innovation, using a regression discontinuity design that relies on “locally” exogenous variation generated by elections that pass or fail by a small margin of votes. Passing a union election results in an 8.7% (12.5%) decline in patent quantity (quality) three years after the election. A reduction in R&D expenditures, reduced productivity of inventors, and departures of innovative inventors appear to be plausible underlying mechanisms through which unionization impedes firm innovation. In 2015, the Open Road Alliance surveyed hundreds of funders and grantees to explore questions about risk and contingency funding. The next year, Open Road partnered with Arabella Advisors for a qualitative analysis of existing foundation policies and procedures related to risk. Economic, Policy uncertainty under political opaqueness imposes great impact in the capital market. I construct ex ante cross-section of firm sensitivity to China Economic Policy Uncertainty (CEPU) index from Baker, Bloom and Davis (2013). This measure of policy sensitivity is significantly negatively predictive of a firm’s market value and Tobin’s Q. Cross sectional tests show that the negative effects are stronger in SOEs= for firms with higher agency problems, and for firms operating in market with lower degree of competition or market disciplining. The evidence suggests that high level of policy influence causes significant value destruction in the capital market.

This study examines whether the premises of inter-firm competition and cooperation on cluster performance outcome hold true in the context of China. By examining 87 township clusters in Jiangsu Province, we find that cluster performance is co-determined by the intensity of inter-firm competition and cluster innovativeness. Our results also show that the cluster's competitive intensity mediates the relationship between cluster size and cluster performance, and that a cluster's R&D centers and inter-firm joint actions positively affects a cluster's innovativeness, which in turn contributes to cluster performance. Research and development (R&D) collaborations, common in high-tech industries, are challenging to manage due to technical and market risks as well as incentive problems. We investigate how control rights, options, payment terms and timing allow the innovator to capture maximum value from its R&D collaborations with a marketer. Our study reveals a counterintuitive result; the innovator may, under certain conditions, prefer to grant launch control rights or buy-out options to the marketer despite the fact that both terms restrict its downstream actions. While the benefits of beginning evaluation efforts at a program’s inception are well known, for a variety of reasons many organizations are unable to do so and instead begin these efforts closer to a program’s conclusion.

Previously reported findings from a sunset evaluation of the Orfalea Foundation’s School Food Initiative showed positive outcomes of the initiative’s activities and provided recommendations for organizations interested in engaging in similar efforts. Because the evaluation was begun as the foundation’s activities were winding down, it required creative design approaches.
