Intellectual Property, Asian Philosophy And The Yin-Yang School, Peter K. Yu

As an introduction to a special issue on intellectual property philosophy, this article focuses on insights from Asian thought. Such a focus is needed not only to provide balance within this special issue, which includes articles focusing primarily on Western philosophy, but also to highlight the compatibility between Asian philosophy and the notion of intellectual property rights. More importantly, this article aims to demonstrate that Asian philosophy may suggest new ways to address the ongoing and highly complex intellectual property challenges confronting emerging economies and the digital environment.

This paper analyzes notions of culture and human intelligence. Drawing on implicit and explicit theory frameworks, I explore discourses about perceptions of intelligence and culture. These include cultural perceptions and meanings of intelligence in Asia, Africa and Western cultures. While there is little consensus on what intelligence really means from one culture to the next, the literature suggests that the culture or sub culture of an individual will determine how intelligence is conceived. In conclusion, the view is that culture and intelligence are interwoven.

The author presents an international and historical history of one of the earliest melodic percussion instruments made by man. His research suggests the instrument was widespread throughout Asia and Africa, although many other regions claim it to have originated in their country. Known by many names and created from an endless array of materials, this paper reflects the marimbas evolution from the fourteenth century to present day. The writer’s research encompasses the marimbas social roles, musical functions, timbres and styles across many countries as well as its evolution into the twenty-first century.

EXECUTIVE SUMMARY

This essay examines recent decisions of international courts and tribunals—specifically, the 2009 Maritime Delimitation in the Black Sea case between Romania and Ukraine—and draws implications for the territorial and maritime boundary disputes in East and Southeast Asia.

Main Findings The judgment of the International Court of Justice (ICJ) in the Black Sea case is a landmark jurisprudential contribution to the development of the law of maritime delimitation. In this case, the ICJ explicitly provided a three-stage delimitation method—which, although not novel, is a clarification and clear articulation not seen in previous cases.

Early Modern European travelers sought to gather and disseminate knowledge through narratives written for avid publishers and public. Yet not all travelers used the same tools to inform their readers. Despite a shared interest in conveying new knowledge based on eyewitness authority, Grand Tour accounts differed in an important respect from travelogues about Asia: they were less likely to include maps until the late eighteenth century.
