Consent, Culpability, And The Law Of Rape, Kimberly Kessler Ferzan

This Article explores the relationship between consent and culpability. The goal is to present a thorough exposition of the tradeoffs at play when the law adopts different conceptions of consent. After describing the relationship between culpability, wrongdoing, permissibility, and consent, I argue that the best conception of consent—one that reflects what consent really is—is the conception of willed acquiescence. I then contend that to the extent that affirmative consent standards are aimed at protecting defendants, this can be better achieved through mens rea provisions. Two main issues currently threatening Christian colleges include mission conflict and financial viability, and research suggests that there is a relationship between these two. However, current literature about the relationship between mission and finance is mostly qualitative in nature, either being case studies or observations of practice. This research set out to establish the nature of the relationship between mission fidelity and financial health using quantitative methodology. A survey instrument was used to quantify mission fidelity for 81 colleges in the Coalition of Christian Colleges and Universities (CCCU), a national organization of Christian colleges, using Benne’s (2001) Typology of Christian …

This research project examined students’ perceptions of academic advising through an online survey method at select two-year colleges within the Minnesota State College and University System. The purpose of this research was to build upon scant existing research relating to student satisfaction with academic advising models utilized by individual colleges. The purpose was to also identify the academic advising model preferred by students. The sample for this research consisted of 177 students enrolled at two-year state community and technical colleges. One goal of faculty development is to improve instructional practice (McKee, Johnson, Ritchie, and Tew, 2013; Ouellett 2010; Sorcinelli, Austin, Eddy, and Beach, 2006). This goal accords with the design of the Associated Colleges of the South Teaching and Learning Workshop, a faculty development workshop begun in 1992 for 16 residential, liberal arts institutions that comprise the ACS consortium. We surveyed ACS faculty members and observed that they are most likely to engage independently rather than collaboratively to improve their instructional practice, despite stated desires for collaborative opportunities for such work. This article focuses on the use of theatre as a mode of creative scholarship, from the research involved in sketch creation to the presentation of that research to academic audiences. We particularly focus on a specific sketch developed by the CRLT Players—one that explores the consequences of subtle discrimination faced by women scientists in research laboratory settings— to illustrate the ways in which theatre can engage audiences with research results. The article explains how participation in such performances promotes a more active exploration of scholarship than simply reading or hearing a presentation. In higher education, faculty work is typically enacted—and rewarded—on an individual basis. Efforts to promote collaboration run counter to the individual and competitive reward systems that characterize higher education. Mentoring initiatives that promote faculty collaboration and support also defy the structural and cultural norms of higher education. Collaborative mentoring initiatives, however, support all faculty to be lifelong learners. We analyze a reciprocal model of mentoring—a community of practice for mentoring—that integrates collaborative mentoring into faculty’s daily work.
